                                                                          Curious phenomena

At the time of Sun Dawu's arrest in 2003, the Chinese government tried to restrict the author's comments with respect to their accessibility in mainland China. They used rather blunt blocking techniques by blacklisting Sun's name among a couple of hundred forbidden names and expressions. The result was that his sites were either blocked in China or access was delayed which effectively meant a block.

Picture
c. 2014

However, today, the Chinese government with the co-operation of their Canadian counterpart block his comments with more sophisticated tools which limit google searches by those outside and inside China and through computer address. His website though is not blocked in China as it previously was. Tests show that it is not blocked or even throttled in at least four major Chinese cities. The results indicate to the author that while the Chinese government does not want its people or foreigners to read the site through various restrictions; nevertheless, the government itself wants to know about its content. Whatever its goal, though,  the author writes not for everyone, but rather every one.  There is a profound difference.

Shanghai’s highest temperature exceeds 50℃? Officials are busy ‘refuting rumors’
Katherine Miller

August 08, 2022

The high temperatures that have scorched China for the last two months continue. The weather app on iPhone shows that the maximum temperature in Shanghai is above 50°C, but the local Bureau of Meteorology claims it is “not real.” Many netizens do not believe the authorities’ explanation.

On Aug. 5, the Iphone’s weather software showed that the highest temperature in Shanghai that day reached 122 F (50 C). For example, Putuo district reached 123 F (51 C) and Jing’an District also reached 116 F (47 C). However, the local Meteorological Bureau announced that the temperature in Shanghai was only about 104 F (40°C).

Some netizens also said that the temperature data released by the government is “political,”, and it can also meet the “economic needs” of Chinese authorities. Many people said that the temperature in the country never exceeds 104 F, and if the temperature goes above that, work will be suspended and workers will be subsidized.

D. Carlton Rossi regularly exercised outdoors in Saudi Arabia at high noon when the temperature reached 48°C  and -4°C in China at 5:00 am without shirt.  In Saudi Arabia, he wore a T-shirt because otherwise he would have been arrested for immodesty. He prepared for a short or extended fight against anyone, anytime under any cirucumstances.

His ability to undertake strenuous exercise in extreme tempertures may have had something to do with his normal body temperture which is 36°C.  That temperature is below average. There are some who might say he is somewhat cold-blooded while others say he is a warm-blooded romantic.

The Imminent trial of Xiao Jianhua in Shanghai court

The headline in the Wall Street Journal reads "China Set to Put Tycoon Seized in Hong Kong on Trial". It refers to the upcoming trial in Shanghai of Xiao Jianhua (肖建华) who is a Chinese-born Canadian billionaire with several passports. It is rumoured he may be charged with illegal collection of public deposits. Both the former, Conservative PM Mulroney and the Liberal government under PM Trudeau who take their cue from business interests had sought the release of Xiao in 2017. The author can say with 100% certainty that our current Canadian ambassador to China knows nothing about the defendant or the case. The reason is simple. We have no Canadian ambassador to China. What we have is a pseudo-ambassador with business interests whom one may leave up to the reader to identify.

Perhaps the best way to put the case into perspective for the average layman is to quote the words of Chen Li on April 18, 2012 with regard to the Bo Xilai  case. He referred to China’s factional politics, which he characterized as “one party, two coalitions.” Bo Xilai (薄熙来) was formerly party chief of Chongqing and a member of China’s Politburo until his arrest and conviction.

The Liberal and Conservative parties were supporters of Bo---meaning Canadian business interests. This effectively meant "two parties, one coalition" with respect to foreign policy at least. Unfortunately, for Canada, the coalition made a strategic mistake by betting on Bo.

One may speculate that the detention of Xiao Jianhua and the seizure of the assets of Tomorrow Group was less about corruption and more about Xi Jinping's attempt to weaken former party general secretariat Jiang Zemin's influence in Shanghai and Hong Kong. The actual trial of Xiao Jianhua will take place in Shanghai which is the main powerbase of Jiang Zemin (江泽民). One may say without elaboration that ties may have existed between the asset manager and prominent Chinese leaders.

It is no coincidence that stricter COVID-19 controls were placed on Shanghai than in Wuhan where COVID-19 emerged at the Wuhan Institutute of Virology. Shanghai authorities undertook phased lockdown on Tomb Sweeping day or April 05, 2022 whose symbolism is highly significant. The Big Whites (大白 ) wearing hazmat suits were seen on this day in Shanghai as if they were parodies of ghosts terrifying the people.

Herbert Giles who was a sinologist translates the Po 魄 in ancient China as "that part of the soul (as opposed to 魂) which is indissolubly attached to the body, and goes down to earth with it at death..." The Qingming (清明) on the fifteenth day after the Spring Equinox dates to the Zhou Dynasty about 2500 years ago. It is on this day that the waning Moon will appear half-full as it reaches its last quarter ie. it goes down to earth.

Blood-red sky over Zhongshan City, Shanghai on May 7, 2022

On May 6, 2022 the situation in Shanghai turned from bad to worse. The Shanghai government held a conference and “Resolutely won in the Congress of Mobilizing and Fighting to Defend Shanghai.” According to China’s official newspaper, The Paper, the current Party Committee Secretary of Shanghai Li Qiang asked officials at all levels to [quote] “issue orders to send troops at all levels. On May 7, 2022 some people protested and demanded food supplies. The government undertook the "people's war" which might be interpreted as not for the people, but rather against the people.

On May 7th, the skyline of Shanghai turned blood-red in colour for an extended period. Even the children were frightened. It was as if the Apocalypse had arrived. In addition, floods in the south and heatwaves in the north of China have brought devastation to the rest of China. To the Chinese, though, the apocalypse is not the end of days, but rather the end of a cycle. "If the relationship between the masses and its emperor deteriorates to the point of mass unrest and dissatisfaction, the mandate will pass to those who overthrow the emperor and install a fairer system of governance for the people."  The Mandate of Heaven (
天命 ) since the time of the Zhou was withdrawn on May 7th.

While most restrictions were lifted after two months, it was on June 9, 2022 that the Minhang District was placed under "closed management" where one can enter but not leave. Might it be that authorities were alarmed at the scuffle between residents and police in Zhuanqiao Town of Minhang District in May more than they were alarmed at the coronavirus or the enforcement of Dynamic Zero Covid? Immune resistance to SARS-CoV-2 may be achieved, but resistance to government authorities is not tolerated---especially before the 20th Party Congress and the confirmation of Xi to a third term. It may be that Zero controls in Shanghai may last longer than the virus.

Storm over Hong Kong

It was in Hong Kong where Xiao Jianhua operated from and to where Chinese wealth was tranferred. It is anticipated that President Xi will visit the city on July 1st or the twenty-fifth anniversary of the handover of the Special Administrative Zone (SAR) to China. The passage of the National Security Law (香港國家安全法) on June 30, 2020 means that Hong Kong has changed de facto from "One Country, Two Systems" (一国两制) to "One country, One system" (一国一制).

On June 14, 2022, China asserted that it had never given up sovereignty of Hong Kong. That may be interpreted to mean that Hong Kong was sovereign Chinese territory between 1841 to 1997. In other words, China's national, territorial sovereignty is immutable.

Xu Zhiyong (许志永)

Mr. Sun Dawu (孙大午) is a farmer-turned-businessman, and in 2003 he was accused by the government of running an illegal credit cooperative among farmers in Hebei province. His case was one of the landmark cases taken on by rights lawyers when this group of legal professionals were just emerging. Dr. Xu Zhiyong (许志永) wrote, in his 2003 essay The "Illegal" Life of Private Enterprise: Defending Sun Dawu,” “providing legal assistance to Sun Dawu is not merely about helping Mr. Sun himself; we are also helping many entrepreneurs who find themselves in similar positions, helping to create a better environment for our nation’s private enterprises to survive and develop, and helping to further the development of reform. We are willing to work hard and serve as legal volunteers promoting social change.” – The Editors

Land disputes in China are becoming more common, intensive and pervasive.  One of the most volatile areas are between farming villages and state-owned-farms. Xi Zhiyong witnessed the outcome of such a dispute in his own hometown. He tried to act as a mediator. At Dawu City, historical land disputes between Dawu Group and the state-owned-farm ultimately led to mass arrests, seizure of property and complete annihilation of family and business.

                                     One Life for One Dream

It was the time of the wheat harvest, and just three days before I arrived something big had happened in my hometown. There had been a land dispute between a village and a state-owned farm. When farm employees arrived under police protection to harvest the wheat on the disputed land, the confrontation turned violent. Police opened fire, killing four villagers and injuring seven. In the chaos, villagers took two hostages from the other side, also seizing two handguns and a jeep.  At the moment of my arrival back home, police and the villagers were engaged in a standoff at the village entrance.

The next day, I rode my bicycle to that village. At first, I just chatted with the villagers as a student, gaining their trust. Later, I spent the afternoon talking with village leaders, eventually convincing them to release the hostages. I of course promised them that I would be willing to provide them with legal advice with regard to their land dispute.

Even though I clearly told the villagers that I was only a university student and not a reporter, it still made the local government a bit nervous. That evening, the county party secretary came to my house. He claimed to be there to express his greetings and thanks, but in reality he was looking into me. I told him that he could relax and that I was acting in everyone’s common interest and merely hoped to help the two sides mediate. I later learned that while the county party secretary was visiting our house, the chief of the city public security bureau was waiting just outside the gate to our family’s courtyard.

During the summer there were two incidents involving land disputes between Dawu Group and Xushui State Farm. They are termed the June 21st and August 4th incidents  “6.21事件”和 “8.4事件".

                           Seventeen Year Periodic "Circadian Rhythm"

Over the years, there were many trials and tribulations faced by the Group due to property disputes of a historical nature going back to the 1950's and more recently to an intellectual property dispute resolved at the Supreme Court. The main dispute though was between Dawu Group and Xushui State Farm which is only an organ or agent of the government; so, its actual ownership is unclear. The dispute involved land. However, despite these  disputes it is indisputable that common prosperity was achieved by 9000+ employees of Dawu Group through a system that emphasized people rather than profit.

                                                Outsiders and Insiders

On the other hand, those within China place a greater emphasis on the issue of land disputes. This explains why they are most interested in the land disputes between Dawu Group (大午集团) and Xushui State Farm (徐水国营农场) which are typical of other land disputes in many aspects. Issues concerning land have been lingering or should one say festering since the time of the Great Leap Forward. One wonders why the government can't solve these issues or rather why it doesn't want to solve these issues over the span of seventy years? What possible motive may it have to prefer ambiguity over certainty?  The reader will notice that while in China it is safer to request clarification by posing questions than answers through edification.

                                       The August 4th Incident  8.4事件

On August 04, 2020, the discord between Dawu Group (大午集团) and Xushui State Farm (徐水国营农场) came to a head.  The "Minutes of the Public Security Bureau [2020] No. 1 Meeting of Xushui District Public Security Bureau of Baoding Municipality" and other documents suggest prior coordination, planning and preparation (behind the scenes between various authorities) for the demolition of the mobile structures and fence on the Dawu property which was to take place at 5:00 am.  The whole scheme resembles entrapment.

                                   The Demolition Incidents

The trigger for the arrests and seizure of Dawu Group 大午集团 were the land dispute incidents of 6.21 and 8.4 against Xushui State Farm in 2020 which are known in Chinese as 2020年针对徐水国营农场的6.21和8.4土地纠纷. Three of the charges relate specifically to the 8.4 incident of August 04, 2020. The following abbreviated account is provided through the courtesy of China Change.

On August 4, 2020, the state-owned farm obtained the protection of a large number of police from the Xushui District Public Security Bureau (PSB) through a mere written request without prior notice to Dawu Group, without negotiating with Dawu or taking other legal approaches. The state farm personnel unilaterally demolished Dawu's enclosure and mobile houses valued at 18,000 yuan..."

                                        "Freak" State Farm

Sun Dawu's new puzzle: What is a state-owned farm?

In Sun Dawu's view, the state-owned farm is like a "freak": its business activities have nothing to do with its superiors, its profits and losses have nothing to do with its superiors, and the amount of money it makes is not handed over to the state or the government. However, the superiors will still provide various compensations to the farm according to the agricultural land (the original situation was that farmers pay agricultural tax, and the farm also pays agricultural tax; now farmers enjoy a subsidy of more than 80 yuan per mu, and the farm also enjoys it), and the farm operates in a market economy. Being conceited, I can't see what it has to do with the "country".

In 2003,  Xu Zhiyong volunteered to be the lawyer of Sun Dawu upon his arrest. His lawyers disputed the charges of fostering financial disorder, pointing to the general disarray of China’s finances.  Harvard Law School educated Xu Zhiyong, one of China’s leading lawyers, published an article titled “Why We Should Defend Sun Dawu.”

Opening statement of defence lawyers in 2003

The full defence team consisted of Dr. Xu Zhiyong, Zhang Xing and Zhu Jiuhu

Defence lawyer Xu Zhiyong argued [in 2003] that Sun had not caused harm to the public. He said that unlike many state banks that failed to invest money properly, Sun only used the money he raised to expand his business, which made a significant contribution to the local economy.

Mr. Sun Dawu (孙大午) is a farmer-turned-businessman. He was accused by the government of running an illegal credit cooperative among farmers in Hebei province. His case was one of the landmark cases taken on by rights lawyers at a time when this group of legal professionals were just emerging.  Dr. Xu Zhiyong (许志永) was one of them.                                                                 The Year of the Two Suns

Reprint from March 13, 2016

It was the year 2OO3. That was the year of the two Suns. If we look up into the stars it is not so uncommon to see a binary star system. [Yet it wasn't until recently that we could imagine a binary star system with life  ie. Kepler-35A and B].  However, 2OO3 was an exceptional year because it was the beginning of the civil rights movement in China. Since civil rights legislation had  been enacted in 1986--this was its actualization. It was the year when two Suns could be figuratively seen in the sky over China—namely, Sun Zhigang (孙志刚) and Sun Dawu (孙大午).

Picture

Sun Zhigang was a recent university graduate from Hubei Province. He had been offered work in the city of Guangzhou in the province of Guangdong. However, he was arrested on the street because he did not hold a temporary work permit. There was a suspicion that he was an “illegal immigrant”.

It may be difficult for a westerner to understand the term “illegal immigrant” as it applied to China in 2OO3.  For example, there is quite a controversy, today, in the United States concerning illegal immigrants.  This controversy is being capitalized upon by businessman Donald Trump in his campaign for President. He advocates sending back illegal Hispanic immigrants to their country of origin and building a Great Wall between the United States and Mexico. However, an illegal immigrant in China was one who comes from one province and illegally tries to live and work in another province without the proper ID card, temporary residence permit and work permit. Normally, if one can use that term, he would be held in custody and repatriated.  Repatriation though does not mean he would be sent to another country, but rather back to the province from which he came.

The news reported by the Southern Metropolis Daily of Guangzhou was stunning and reverberated throughout China. Sun Zhigang was dead three days after his apprehension. He had been beaten to death by guards and other inmates in the medical clinic affiliated with the custody and repatriation center. One wonders why he was in the medical clinic in the first place.

In May 2OO3, three legal scholars—among who was Xu Zhiyong—petitioned the National People’s Congress Standing Committee for change or abolishment of the Custody and Repatriation Measures.  They argued the measures would restrict the personal freedom of citizens. In June, the State Council announced the measures would be abolished.  Xu also defended Yu Huafeng (喻华峰) who was General Manager of the Southern Metropolis Daily that reported the story.

Picture

On May 27th of 2OO3, a second luminary was arrested. His name was Sun Dawu (孙大午). He was a self-educated farmer from Langwuzhuang, Xushui County, Hebei. Sun had given speeches at Beijing and Tsinghua universities to promote the rights’ of farmers, rule of law and more fair representation—although the latter was expressed more stridently. "Farmers should stand out and speak for themselves " he declared. "They should have their own organizations and have their own demands" The author notes that these sentences are still censored on the internet of 2015. As a matter of fact, he was in the process of starting his own private college in cooperation with domestic and international colleges and universities to complement his private middle school of 2000 peasant students from various provinces. Sun also established a private financial cooperative which paid higher interest rates than state-owned banks such as the state Agricultural Bank where he had worked.

While the coastal regions of China embraced capitalism with their acceptance of private ownership of land and investment in a free market economy, Langwuzhuang was mired in a quagmire of poverty. Local officials and institutions were ossified in the collective era and area. The loquacious Sun was a quadruple challenge to their authority in terms of a private financial collective, private land, private schools and free speech. The local banks in particular were upset about loss of deposits to the Dawu Group.

The upshot was that Sun, his brothers and a manager were arrested for taking illegal deposits (a rather grey area in terms of banking).  However, the 4742 depositors of the financial cooperative made no claim against him. The financial harm though done to the Dawu Group was irreparable because proper supervision of the business was absent and not appointed by the court. The equivalent of hundreds of thousands in US dollars were seized from the company safe by authorities and never returned. Should not the "loan" be repaid with interest?

The website of Taiwujituan or Dawu Group was shut down. The author established 50 websites with different content, titles, keywords and passwords modelled on the ARPANET protocol to tell Sun’s story because he could not speak. Sun was held incommunicado without legal representation for a long period after his arrest and without chance of bail.

The author tried to hire one of the best international human rights lawyers in the United States on his behalf, but even his son, Sun Meng, could not visit his father. Without Sun’s written approval no lawyer could be hired. It might be well advised for civil rights activists in China to hire in advance of arrest this kind of international legal representation specializing in civil rights with the arrest and incarceration for the second time of the civil rights activist Xu Zhiyong in 2014 and scores of other lawyers and those lawyers representing them in July 2015.

It may be in the People's Republic of China of 2015 and beyond that the only way to secure protection for a civil rights activist of his self, family and businesses is to hire an international civil rights' expert in advance of arrest. It is estimated that a retainer of $1,000,000 US held in trust and earning interest at a US bank would be required. This method also helps fulfil a 100 year plan and promote civil rights. Furthermore, it guarantees that if a civil rights activist is arrested that the case will garner international attention and scrutiny.

Sun’s trial in November 2OO3 made international headlines. Sun was defended by three Chinese lawyers which included Dr. Xu Zhiyong. Sun had tremendous support from farmers, intellectuals, entrepreneurs, reporters and net citizens. The result was that he was sentenced to time served and put on four years’ probation.

Xu Zhiyong said that "We moved on in 2003 by registering a public interest organization. We represented Sun Dawu's case and we promoted the election of the People's Congress. Starting from the Sun Zhigang Case we focused on individual cases that had wide significance for the defense of civil rights and the push for system building. Many people referred to 2003 as the start of what would be known as the citizen's rights movement."

The Civil  Rights Movement in China and the Total Lunar Eclipse Tetrad of 2003-2004

It may be said that the civil rights movement in the United States gained impetus with the arrest and conviction of Martin Luther King for participation in anti-segregation mass-meetings, protests and sit-ins in Birmingham Alabama which began in April 1963.  In the “Letter from Birmingham Jail” he argued that individuals have a moral duty through non-violence to disobey unjust laws. However, it took four decades or rather eight five-year plans for the civil rights movement to begin in China. Sun's plan is for 100 years. The year 2003 marked its emergence and one remarkable man came to the forefront – Sun Dawu.

Postscript

Sun began rebuilding  Dawu Group.  In 2004, Sun established China’s first Family Business Constitution with elections. He undertook extensive travel throughout China to give speeches on the invitation of various groups , submitted to interviews and wrote incisive essays. He became adept at communication through blogging. On the 30th anniversary of Dawu Group, he united the Sun family from different provinces of China by holding a meeting of over 1300 delegates in the new conference center. The guest of honor was Lily Sui-fong Sun 孫穗芳 who is the granddaughter of Sun Yat-Sen. By 2015, Sun Dawu was warning about the land of darkness and injustice in terms of the agricultural land policy and the dire consequences if problems are not resolved.

After more than two years in prison,  well-known                 dissident Xu Zhiyong 许志永 goes on trial

Pime Asia News

June 15, 2022

The human rights lawyer, who is accused of trying to subvert state power, faces life in prison, but his lawyers will plead not guilty. The manner in which he was arrested is disputed. He was detained after he called for Xi Jinping's resignation in the wake of the outbreak of the pandemic. Activists linked to him are in the same situation.

As reported by the South China Morning Post, which cites friends of the activist and legal sources, the Linyi People's Intermediate Court (Shandong) informed Xu's lawyers that a pre-trial hearing is scheduled for this Friday.

This suggests that a full trial is imminent. The same is the case for Ding Jiaxi, Xu's colleague, who is also in prison awaiting trial on the same charges.

They were arrested in late 2019 and early 2020 after attending a gathering with fellow activists and lawyers in Xiamen, a city in Fujian province, to discuss the development of civil society and democracy in China.

Before his most recent arrest, Xu published an article in early 2020 on social media in which he called for President Xi Jinping to step down for his “inability to handle major crises”, including coronavirus outbreaks.

Health code into a stability maintenance tool?  Zhengzhou depositor red code incident sparks public outrage

Since the beginning of the outbreak, China has used mobile phone apps to identify and isolate people who may be spreading the virus. Today, the use of that data in a city in central China could be deeply troubling: to deter would-be protesters.
Not long ago, a group of people from all over China set out to Zhengzhou city to protest the freezing of their deposits while investigations were carried out on several local banks. But after they arrived, many found that the so-called health code on their phone had changed from green (i.e. normal) to red, meaning they would not be able to move freely.

Tom Zhang, the owner of a textile company in Zhejiang, said his health code turned red on a train to Zhengzhou on Sunday, but he was from a town with no coronavirus cases. After arriving in Zhengzhou, he said, police stopped him and told him a red code — which usually stands for infection or close contact — meant he posed a public health risk. He said Zhengzhou police detained him at a local library for about 12 hours.

Washington "Save America" Rally

A Tale of Two Cities and Countries

It is commonplace in Canada for critics to compare the application of the War Measures Act of October 1970 under the government of Pierre Elliott Trudeau and the application of the the Emergencies Act under Justin Trudeau in February 2022.  It is said that the Emergency Act which was enacted in 1988 was a result of an overreaction and overresponse by Pierre Elliot Trudeau in 1970 with the application of the War Measures Act. His most famous expression was "Just watch me!"  At that time, civil liberties were suspended and individuals were arrested without charge. Ironically, a similar criticism was made of Justin Trudeau at the time of what has been termed the Freedom Convoy when he justified using the Public Order Emergency provisions of the Emergencies Act to quell peaceful protests in order to ostensibly defend the national security of Canada. However, this particular analysis looks at matters from a different point of view. It contrasts the insurrection in Washington, D.C on January 06, 2021 with the three week protest called "Freedom Convoy" in Ottawa during late January and February along with temporary closures of US-Canada crossing points.

Picture

The rambling and incoherent speech of Trump given at the "Save America" Rally on January 6, 2021 in Washington, DC to dismiss the results of the election set in motion the protests at the Capitol which followed. The rally was held at the Ellipse which is close to the White House. There are two statements in the speech which are most often quoted. His critics point to the words "We fight like hell. And if you don't fight like hell, you're not going to have a country anymore." His defenders point to the statement "I know that everyone here will soon be marching over to the Capitol building to peacefully and patriotically make your voices heard."

Basically speaking, Trump's two statements which are to be taken together are doublespeak. They are contradictory; yet, both are  viewed by the speaker as true.    The "fight like hell" phrase expresses feelings while "the make your voices heard" phrase represents logical thought. Trump is inducing hysteria through cognitive dissonace by inciting the crowd to put their feelings ahead of their contradictory thoughts so that they can fight the weak "warriors" in the Senate.

Picture

It reminds the author of the science-fiction movie called "The Day the Earth Stood Still" (1951) when a humanoid alien visited the Ellipse in a UFO. The alien became a projection of the nation's fear of Communists. In real life, hysteria may have been the explanation of the radar sighting over Washington on July 19, 1952. Two unidentified objects were sighted hovering over the White House and another over the Capitol.

Picture

Klaatu's speech though  was much more succinct and logical. It wasn't an expression of the "Big Lie", but rather the "Big Truth".  Disarm or the Earth will be vaporized.  He said "There must be security for all -- or no one is secure. This does not mean giving up any freedom except the freedom to act irresponsibly." Both Trump's speech which expressed views disassociated from reality and the violent interruption of the legal proceedings at the Capitol were acts of irresponsibility.

Picture

Some protesters arrived at the Capitol before Trump's speech ended which dispels the idea of spontaneity. They were prepared for an insurrection with respect to their intentions, plans and what they brought along with them. The situation quickly morphed into an attempted coup d'etat when insurrectionists breached perimeter fences by assaulting police. They then broke into the Capitol building. The goal was to forcefully and forcibly overturn the election.

Picture

Trump's reaction to the turn of events was underwhelming. He watched events on TV from the private dining room of the White House as they transpired at the Capitol. [The New York Times, citing unnamed Defense Department officials, said it was Vice President Mike Pence, not Trump, who approved deployment of the D.C. National Guard that afternoon. The Times also cited a “person with knowledge of the events” who said Trump “initially rebuffed and resisted requests to mobilize the National Guard “and that the “mobilization was initiated with the help of Pat A. Cipollone, the White House counsel, among other officials.”] The first National Guard member arrived at about 5:40 pm or only after most of the violence had subsided.

Canadian Federal election held on September 20 2021

The federal election in Canada was quite different. It took place on September 20, 2021. With virtually no platform, Trudeau called an early election for no apparent reason except to try and change his status from a minority to a majority leader.          He failed to change anything. Remarkably, the results of the uncontested election were similar to those of the   2019 election. He gained only one seat. It is no exaggeration to say that it was the most pointless election in Canadian history.

However, the election was not the least consequential. It was held during the fourth wave of the Delta variant of COVID 19.  For example, on September 9th, the country reported 4,179 new cases and 27 deaths.  It cannot therefore be said by holding an early, unnecessary election that the health and safety of Canadians was of paramount importance to the government when people stood in line at polling stations during a pandemic.

Picture

As a re-elected minority leader, Trudeau didn't exactly speak from a position of strength at the the North American Leaders' Summit sometimes called the Three Amigos Summit on November 18, 2021. It was held at the White House. The cameras zoomed in on Trudeau's socks which for some unknown reason he is proud. One might imagine him saying to President Biden "Sock it to me" with regard to the proposed electric vehicle tax credits.

Those proposals have not yet become law because they face opposition in the Senate. A tax credit of $7500 would be allowed for electric vehicles made only in the US from 2026.  In addition, another $4500 of tax credits would be available for purchasing cars with union labor. These tax credits would devastate the Canadian auto parts industry. Obviously, both Canada and Mexico would like the EV credits extended to electric vehicles made in their respective countries, too.

One of the areas of co-operation at the summit in a somewhat minor area involved COVID-19. There was broad agreement on ending COVID-19.  In terms of specifics, Canada and Mexico agreed to redistribute vaccines they received from the United States to other Western Hemisphere countries.

It so happened that the Government of Canada through the Public Health Agency of Canada "announced adjustments" to its border measures with respect to COVID-19. This announcement was made on November 19, 2021. The word "adjustments" rather minimizes significant changes with respect to entry requirements of certain groups such as international students, athletes and service workers.  All of these travellers, as of January 15, 2022, who were previously exempt from entry requirements, must be fully vaccinated.

Surprisingly, foreign national truck drivers (who are regarded as essential service workers) are no longer exempt from entry requirements.  It is surprising because the The North American Leaders' Summit had just been held a day earlier and auto parts was the key issue. The "adjustment" means that all foreign national truck drivers will be turned back if they are either not vaccinated or partially vaccinated.

The list of requirements as of January 13, 2022 to qualify as a fully vaccinated foreign national truck driver are as follows:

1.  Have received at least two doses of a vaccine accepted for travel, a mix of two accepted vaccines  or at least one dose of the Janssen/Johnson & Johnson vaccine

2.    Have received their second dose at least 14 full days before they enter Canada. For example: if a driver received their second dose anytime on Saturday, January 1, then Sunday, January 16 would be the first day that they would meet the 14-day condition.

3.    Have submitted all required COVID-19 information into ArriveCAN.

Several questions arise from the tighter vaccination requirements of foreign national truck drivers. Was it the  result of an agreement or understanding  between the United States and Canada at the summit? It hardly seems that the United States would agree to such a thing. On the other hand, were the tighter requirements imposed arbitrarily by the Canadian government, and if so, was it a retaliatory measure in response to Biden's Buy America proposal as it pertained to the EV credit and auto parts?  Tighter requirements would force vaccination of American truckers and could possibly slow down Just In Time (JIT) deliveries at the border points in the future. Finally, were the "adjustments" just the opening shot of the Canadian government before it threatened retaliatory tariffs on December 10th against American exports?

Personally speaking, the author knows what the truckers are going through with respect to requirements. The Ontario government has regulated him out of the trucking profession despite the shortage of drivers in the province. He used to hold a Class A driver's licence which qualified him to drive a tractor trailer. If you think it is easy to drive a truck, for example, with a double-clutch as is used on troop transports then try it some day. Then along came a Z brake endorsement requirement for which he should have been grandfathered in. Only a brain surgeon could understand the technicalities of the 75 page booklet. He was also hit with a series of medical tests over the years which cost him time and money for trips to the doctor and lost work for those days.  All of this red tape didn't make him a better driver or the roads safer.

Picture
Tamara Lich who was one of the organizers of the "Freedom Convoy"

The Freedom Convoy emerged in mid-January.  One of the Canadian leaders of the convoy was Tamara Lich who had been involved in small-scale fringe political activities. She helped secure support for the convoy on both sides of the border. It is probable that the political orientation of the Freedom Convoy was conservative and pro-Trumpian.

Picture

The truckers railed and rallied against COVID 19 mandates imposed on them when they tried to perform their essential services. American truck drivers who crossed the border didn't quite understand why they were being forced to meet standards that a high percentage of Canadian truck drivers met without much objection. Canadians truck drivers sympathized with the concerns of their American counterparts which suggested that their compliance with Canadian regulations was less than voluntary and more disagreeable.

Picture

The loathing felt of COVID-19 mandates explains the truckers' occupation of  Ottawa. In typical Canadian fashion which prioritized peace and order it was largely civilized. Of course, the protesters wished to speak to the "minority of one",  but he was nowhere to be found. It seems he vanished from Ottawa to isolate himself from the contagion of diesel fuel and honking horns. It must be admitted though that the Ottawa protest was predominantly symbolic. That status could at least be understood by "the minority of one" who relishes symbols and slogans.

The substance though of the Freedom Convoy involved the blockade of US-Canada border points.  It is said that "some auto parts cross the US, Mexico and Canada borders “seven or eight times” before being assembled into the final vehicle." The EV tax credits could eliminate almost all transportation jobs taking auto parts back and forth along north-south lines.

Picture

The crucial artery for the automotive supply chain is the Ambassador Bridge between Windsor and Detroit. Pickup trucks undertook a blockade of the bridge thus hindering the crossing of automotive components and parts.  Other crossings were also blocked in Coutts Alberta, Emerson Manitoba and Surrey British Columbia.

The Emergency Act which was imposed by Justin Trudeau (Just In Not Time)  on February 14th (as his Valentine's gift to Canada) was not only overkill, but also overwhelmingly unnecessary and inappropriate. It was like taking a sledgehammer to crush a nut---an analogy used with the application of the War Measures Act in 1970 under Pierre Trudeau. Basically, Justin Trudeau did too little too late to show he was in charge even though he was miles away in self-imposed isolation. The provinces had enough power to deal with the situation without the Federal government resorting to extraordinary powers which had never been used in modern Canadian history.

Picture

                                                            Just watch em!

One of the unknowns but not unknowables of the government's response to the peaceful occupation of Ottawa was the use of a new surveillance plane on a so-called training mission of the Canadian special forces. The  US registered King Air aircraft was seen circling Ottawa on Jan. 28, Jan. 29, Feb. 3, Feb. 10 and Feb. 11 according to Stephan Watkins. The use of the surveillance plane skirted an official directive of the Department of National Defence that it was not to do so.  "Canadian special forces had access to similar aircraft in Afghanistan to track and target insurgents."

However, there are several problems that arise with the application of classified surveillance technology at that time. The occupation of the city of Ottawa was peaceful. There were no riots. There were no kidnappings. There was no attempt to enter Parliament. There was no use of firearms or bombings. No one was hurt or injured. What could justify the use of this invasive technology before the passage of the Emergency Act about a week later? If it had been necessary then wouldn't it have been more appropriate to use this technology with the passage of the act itself?

The events of January 06, 2021 in Washington at the Ellipse and Capitol and the events involving the Freedom Convoy in Ottawa which expanded to the cross border points between January 15 to February 23, 2022 show a marked contrast. The Capitol insurrection threatened the life and liberty of Senators and can't be regarded as anything less than a coup d'etat. Trump appears to have rebuffed and resisted the use of the National Guard which didn't arrive until almost five hours after the disturbances had begun.

Ironically, the seeds of the Freedom Convoy's protests in Ottawa which developed into a full-scale peaceful occupation of Ottawa began the day after the North American Leaders' Summit in Washington. The Canadian government announced adjustments to its COVID-19 border policies with respect to certain groups which included foreign national truck drivers. In all likelihood, this particular adjustment was triggered by Ottawa's dissatisfaction with the EV tax credits proposed by Biden which would decimate Canada's auto parts industry in the future. The day of implementation of the adjustments which began on January 15th coincided with the beginning of the Freedom Convoy.

Obviously, the Canadian government hadn't fully understood the implications of its decision to require foreign national truck drivers to be vaccinated according to Canadian standards. The Freedom Convoy occupied Ottawa and basically paralyzed Parliament. Trudeau disappeared to parts unknown because he was infected with COVID.  The protests spread to cross-border points, but had negligible impact on the auto parts industry.  Trudeau's use of the Emergency Act was both a misstep and overstep of power because the provinces had adequate resources and legal means of enforcement to deal with the chaotic situation.

Chinese police arrest nine after women attacked at restaurant

Vincent Ni and agencies

June 11, 2022

Nine men have been arrested over a vicious attack on a group of women at a restaurant in northern China, in a case that prompted outrage over predatory sexual behaviour and violence against women.

CCTV footage of the incident widely circulated online shows a man placing his hand on a woman’s back as she shares a meal with two companions at a barbecue restaurant in the city of Tangshan in Hebei province in the early hours of Friday.

After the woman pushes him away, the man strikes her before others drag her outside and deal a barrage of blows as she lies on the ground. Another woman is also knocked to the floor.

On the social media site Weibo, the related hashtag has generated more than half a billion views and tens of thousands of comments on Saturday, where many users, particularly women, urged the authorities to crack down on gender-based violence.

Millions of internal migrants out of work: Xi's 'common prosperity' just a slogan

Asia News

June 11, 2022

The "common prosperity" invoked by Xi Jinping to redistribute national wealth is increasingly revealing itself to be a mere slogan, especially for millions of migrant workers over 50. Many of them are unable to find work due to stringent recruitment and job security regulations, especially in the manufacturing and construction industries. And without even being able to benefit from social shock absorbers.

According to data published in April by the National Bureau of Statistics, 300 million internal migrants moved in search of work in 2021: 80 million were over 50 years old, around 27% of the total.  They mostly come from the rural areas of China, and only if they move to cities with a population of less than three million will they have the chance to obtain residency, and thus access to local health and social facilities.

https://www.asianews.it/news-en/Millions-of-internal-migrants-out-of-work:-Xi's-'common-prosperity'-just-a-slogan-55953.html

Dawu Group achieved common prosperity in a socialist, utopian paradise under the Private Entrepreneurial Constitutional System. It ended with the sentencing of its executives to prison and the forced auctioning off of the Dawu Group.

The Chinese people have lost their last hope for prosperity and happiness. When the good is deemed evil and the evil is deemed good then all is lost.

Der Verlust der Hoffnung ist das Ende von Eden
und die Utopie wird zu einem nicht existierenden Ort.

The leader of the association was Sun Kai (b. c1921) who had learned in his teens with twenty or thirty others. His son was the boss of a large company in the village, with thirteen factories; most of the musicians worked there. Some of the old members used to get together to play for fun, and the youngsters who heard them became keen. Sun Kai had produced 1,000 yuan of his family’s new-found wealth, the factory had given 2,000 yuan, and the rest of the members had contributed about 600 yuan in all, with which to buy instruments. They studied every evening after knocking off from the factory, using cipher notation.

China Plans for Years of Covid Zero Strategy With Tests on Every Corner

After a bruising lockdown in Shanghai and severe curbs in Beijing were needed to halt the spread of Covid-19, China is doubling down on mass testing in a move that’s dashing hopes for a shift away from its costly Covid Zero strategy.

“Absolutely it can help to detect omicron early, especially if everyone is having to test every two days,” said Mina, now chief science officer at eMed, a company that offers at-home Covid tests and telemedicine services. “However, it is an exceedingly difficult approach.”

https://www.bloomberg.com/news/articles/2022-05-31/china-plans-for-years-of-covid-zero-with-tests-on-every-corner

This might be called "Double" Dynamic Zero-COVID Strategy. It goes way beyond Covid testing. It reminds the author of how prisoners in the West who have been granted probation must report to their probation officer once a week--but this is every two days. It probably takes the local government two days to evaluate a full test. China mainly uses the  Reverse Transcriptase Polymerase Chain Reaction (RT-PCR) technique. 1.

Who knows what the results of the tests really are? The "usual suspects" can be locked up for several weeks if the  government were to falsify the test results. You would be told you are locked up for your own benefit and the benefit of others. Recently, a Beijing man tried to avoid testing and hundreds of others were locked up with whom he might have come into contact.

Optimists are hoping this is a short-lived program or up until the 20th Party Congress in October or November. However, even if that is true, two days does not give people enough time to go home to another city during the National Holiday in October.

The hardest hit segment of the population will be the migrant workers who number about 221.21 million according to Statistical Research Service whose latest report was released in April 2022. The number comprises both Inter and Intra provincial workers in 2021.  2.

Pessimists would say that once the stations are in place that even if testing is not done every two days that they will be repurposed as surveillance  stations. I remember almost three decades ago showing a friend from another city around my neighbourhood in Chaoyang district in Beijing. (That is where the first Covid lockdown in Beijing took place in 2022.)  It was nighttime and we passed a a black, non-descript shack along the street. It was unlit. I casually asked him if he saw the man in the shack. He retorted that there was no one in the shack. He walked back to the shack to prove I was mistaken, but discovered the shack was occupied. He showed less incredulity when I pointed out the microphones in the bushes across from the four star hotel. Basically, I summed up the issue by saying that Beijing was the political center of China and that surveillance was everywhere.  There were eyes watching you and ears listening to you all the time.

Negative COVID Test Has Never Been So Meaningless

A string of negatives can still presage a clear-as-day positive.

The Atlantic

Katherine J. Wu

June 10, 2022

Tests are not and never have been perfect, but since around the rise of Omicron, the problem of delayed positivity has gained some prominence. In recent months, many people have logged strings of negatives—three, four, even five or more days in a row—early in their COVID-symptom course. “I think it’s become more common,” says Amesh Adalja, an infectious-disease physician at the Johns Hopkins Center for Health Security.

Right now, experts are operating in a vacuum of evidence: “I don’t even know of any data that systematically evaluates this,” says Yonatan Grad, who’s studying the viral dynamics of SARS-CoV-2 at Harvard’s School of Public Health. But several phenomena could plausibly be muddying the testing timeline.

China's commercial hub of Shanghai will lock down millions of people for mass COVID-19 testing this weekend - just 10 days after lifting its gruelling two-month lockdown - unsettling residents and raising concerns about the business impact.

Racing to stop a wider outbreak after discovering a handful of community cases, including a cluster traced to a popular beauty salon, authorities have ordered PCR testing for all residents in 14 of Shanghai's 16 districts over the weekend.

By Jessie Yeung, CNN Business

Updated May 26, 2022

China's cabinet held an emergency meeting with more than 100,000 participants on Wednesday, according to state media, as top leaders urged new measures to stabilize an economy battered by the country's stringent Covid-19 restrictions.

Investment banks are slashing their forecasts for China's economy this year. Earlier this week, UBS lowered its full-year GDP growth forecast to 3%, citing risks from Beijing's strict zero-Covid policy.

There isn't a clear end in sight to the crisis, with authorities still struggling to contain the spread of the virus and top leaders insisting on pushing forward with zero-Covid.

One good economist is better than 100,000 party participants. What is Sheng Hong (盛洪) saying? He was a co-founder of the former Unirule Institute of Economics (天则经济研究所) in 1993 which was shut down due to government pressure.

‘The Last Generation’: The Disillusionment of Young Chinese

New York Times

Li Yuan

May 24, 2022

Many believe that they’re the most unlucky generation since the 1980s as Beijing’s persistent pursuit of the zero Covid policy wreaks havoc.

The “run philosophy” and the “last generation” are the rallying cries for many Chinese in their 20s and 30s who despair about their country and their future. They are entering the labor force, getting married and deciding whether to have children in one of the country’s bleakest moments in decades. Censored and politically suppressed, some are considering voting with their feet while others want to protest by not having children.

My interpretation is somewhat different. The flight or fight scenario is usually chosen.  In 1966, the students of the Red Guard were radical Maoists. They chose to fight. In 1989, the university students of Beijing chose civil disobedience to achieve freedom.  In the riots that ensued they returned again and again against armed troops. The people supported the students. They chose to fight. According to the Chinese Red Cross about 2600 individuals died. The death of most troops was attributed to friendly fire.  So far,  in 2022,  the students have chosen an inward kind of flight which involves involution and laying flat.  It resembles running away or flight. Will they make good recruits for the military?

President Xi Jinping                                                                            Former President Jiang Zemin

                                                          The Wild Card

President Xi is a powerful leader.  He is also general secretary of the CPC Central Committee and chairman of the Central Military Commission. His philosophy was enshrined in the constitution as "Xi Jinping Thought on Socialism with Chinese Characteristics for the New Era". President Xi seeks a third term in the fall of 2022 at the 20th Party Congress in either October or November. However, there is one wild card which could hamper Xi's ascendancy in the Fall---former President Jiang Zemin (江泽民).

Xi's supporters have tried to establish a personality cult around him called "Xiism" to parallel that of "Maoism" and "Dengism". An example of the cult is the publication in one province  of a Little Red Book with quotations of Xi.  There is some resistance to the cult by Party members who have become enemies on his way up and due to the perception that he has a bland personality.

Xiism though is more than just a personality cult. According to Andreas Møller Mulvad of the Copenhagen Business School,  it is  an "hegemonic project in the making". Basically, Xi wishes for China to achieve world domination while maintaining domestic stability. In the short term, its objective regarding the international front is on rather shaky ground when its Russian ally encountered resistance in its invasion of the Ukraine. In addition,  there is an awakening from complacency of the EC and NATO with the encouragement of the United States.

On the domestic front, its newly named  "Dynamic zero-COVID strategy" (DZCS) has been anything but dynamic against stealth Omnicron. The BA-1 and BA-2 versions have targeted the weaknesses of the policy with respect to non-efficacious vaccines. There is also a senior population which is partly immuno--compromised and under vaccinated. Together, these two deficiencies in policy have meant a rapid spread of Covid, a rising mortality rate, an inability to achieve herd immunity, a draconian lock-down of major cities and high certainty of mutation-variations. At the moment, Omnicron rules---not the Party.

The Party has enforced a particularly repressive and expansive  variant of DZCS against its own people (resembling the "Z" invasion of sovereign  Ukraine to some extent) which has spread like a virus. The fatality figure of 587 for SARS-CoV-2 in Shanghai in 2022 has now exceeded the total number of SARS deaths in China at 349 between 1 November 2002 – 31 July 2003.

Picture
92 year old forcibly removed from apartment to isolation ward
Picture
Alive body knowingly transported to morgue

The shock and awe lockdown of Shanghai has been both vicious and virulent. To illustrate this point it is only necessary to cite two examples which are known by all Chinese internet users. The "Big Whites" in bubble suits broke into the apartment of a  92 old woman who showed no signs of Covid and had had a recent negative test. She was forcibly removed from her apartment to an isolation center. Her daughter whose name is Zhi Ye commented on Weibo that ""There's no limit to the cold-blooded cruelty and violence".  In another incident, a living person was knowingly sealed in a body bag to be transported to the morgue. The person was discovered to be alive upon arrival at the morgue. “The nursing home is such a mess. They sent a living person on a hearse and said they were dead. The undertaker staff said they were still moving … It is irresponsible, really irresponsible,” the person who captured the scene says, according to CNN.

There are various reasons for a stringent, martial-law lockdown of Shanghai.  First and foremost is the pending appointment of Xi to a third term as president.  Second, the Party has deliberately weakened the financial hubs of both Hong Kong and Shanghai by Covid restrictions to restrict the entrepreneurial and financial classes in order to bolster the strength of its own State Owned Enterprises (SOE's). Third, the Party's sacred mission is to reunify Taiwan with the Mainland by peaceful means or if necessary by any means. Shanghai faces the South China Sea and the Taiwan Strait linking Taiwan and the Mainland. "A leaked audio revealed that the Chinese military hosted a meeting in May 2022 to plan an invasion of Taiwan and the South China Sea." Fourth, in order to secure Taiwan it must secure its frontiers. Shanghai is a cosmopolitan city of 21 million. It must be pacified before Taiwan is pacified. It represents the East frontier which is closest to Taiwan. The other frontiers have already been pacified by various means ie. Hong Kong represents the South , Xinjiang the North, and Tibet is the East.

There is one wild card which could hamper Xi's ascendancy in the Fall. It is former President Jiang Zemin (江泽民). His powerbase is Shanghai where he became mayor in 1985 and later Party Committee Secretary of Shanghai. In time, he was elevated to the positions of General Secretary of the CCP,  Chairman of the Central Military Commission and the Presidency.

His economic-political theory was called "Three Represents".  It justified incorporation of the capitalist business class into the Party. One is reminded of the situation of Sun Dawu. His status in the Party was always in a rather gray area. If he had been fully incorporated into the Party then it might have been possible for it to have considered the merits of the Private Entrepreneurial Constitutional System established by Dawu Group in 2004;  as well as, its success in achieving "common prosperity".  Instead, Sun Dawu is under another kind of lockdown on a long-term basis in a prison of Xingtai, Hebei.

Under Jiang's leadership, China achieved economic stability with an average growth rate of 8% GDP annually. This growth rate has declined precipitously due to Dynamic zero-COVID Policy and a hardened political stance under China's current leadership.   In particular, one can say that the economy of Shanghai has been Shanghaied under martial law and lockdowns. Its people haven't even had enough food to eat. They have been told that freedom is an illusion.

In searching for an elder hero,  the most popular figure among China's new generation is Jiang Zemin. They are nostalgic for things of the past.  "Jiang has been reborn as a “meme beacon,” while the social media tide has simultaneously turned in favor of him. This gave birth to a new subculture on the Chinese internet — “toad worship” (moha, 膜蛤)."

It may very well be that the people of Shanghai will remember  China's economic growth under their native son when they are released from lockdown. They may well recall Shanghai's illustrious designation of financial capital of China which is somewhat tarnished these days. They will certainly remember to celebrate the anniversary of Jiang Zemin's 96th birthday on August 27, 2022.

They may not Lie flat (躺平) in doing so. They may celebrate the life of China's paramount leader by singing the lyrics of the Chinese national anthem called March of the Victims which was written by another native of Shanghai whose name was Tian Han (田汉). The first line reads ‘Arise, those who do not wish to be slaves!’ 起来! 不愿做奴隶的人们!

The young "Mohaists" may post Big Posters with the words of the Gettysburg address. It was written by Lincoln and recited from memory by Jiang. One line reads "Government of the people, by the people, for the people, shall not perish from the earth."

Auction of Chinese private enterprise casts suspicion on the CCP

~Gao Zhensai, Special Correspondent of ChinaAid

Monday, May 23, 2022

On the afternoon of April 15, without prior notice, a court order gave a verbal notice regarding the continuation of the auction. According to the ruling, Dawu Agriculture and Animal Husbandry Group was auctioned off to a company named Baoding Ruixi Technology Co., with a transaction price of ¥686.1 million. The auction price matched the previous official evaluation price. The Dawu Group’s ¥5.1 billion (~$762 billion) assets are only worth about ¥700 million after appraisal, and Baoding Ruixi Technology Co. acquired Dawu Group at a significantly low price.

Baoding Ruixi Technology Co. was established on April 12, three days before the auction. It then participated in the auction of Dawu Group assets by Gaobeidian Municipal People’s Court and won the bid. Netizens exclaimed that the company was established for the sole purpose of “looting” the assets of Dawu Group. Authorities calculated the ¥700 million registered capital to match the ¥686 million acquisition of Dawu Group.

Agricultural entrepreneurs like Sun Dawu not only despise power and money transactions but also have the courage to speak out. They have both economic resources and organizational skills. They also put forward ideas on getting rid of poverty from the perspective of fighting for farmers’ rights and calling for political reform from the standpoint of constitutional democracy. Their ideas pose a considerable challenge to the current system politically. They are likely to become a new type of “peasant leader,” so the authorities felt the need to use vague laws to rectify this.

Chinese envoy away from Ottawa post on what embassy calls official business

The Globe and Mail

Steven Chase

May 26, 2022

Beijing’s ambassador to Canada has been away from his Ottawa post since the end of January – attending to what the Chinese embassy described as official business in China.

Last week, Canada banned equipment made by Huawei and ZTE – another Chinese telecom equipment maker – from Canada’s wireless networks, saying a review determined they posed security risks. In response, the Chinese government accused Ottawa of “political manipulation” and warned that Beijing would “take all necessary measures to safeguard the legitimate rights and interests of Chinese companies.”

Why are Canadians only learning now that China's ambassador to Canada has been absent since the end of January?  Is our press muzzled by the government or is it self-censorship?

On a related matter, Canadians have had no ambassador to China since the beginning of January. There are a handful of individuals in Canada who are qualified for the job. Either they are not being asked to serve our country as ambassador or perhaps they have declined the invitatiion. At any rate, this void cannot be filled by any minister of our government---including the Prime Minister. To put it bluntly, we need a "wolf warrior" as ambassador and not another "woof warrior".

From my own perspective, I would say the job has to be entirely redefined. The main problem is that foreign affairs is "foreign" to our government. They have no idea what is going on outside of their domestic bubble and especially how what is "foreign" bursts their bubble.  Nowhere is this more evident than in our relations with China.

'We are the last generation': China's harsh lockdowns could exacerbate population crisis

Analysis by Nectar Gan, CNN
May 16,  2022

And so when a Shanghai family refused to be taken from their home into government quarantine during the city's sixth week of lockdown, a police officer warned them with what he thought would be a powerful threat to bring them to heel -- their children's future.
"If you don't obey the orders from the city government, you will be punished, and the punishment will affect three generations in your family," the hazmat-suited police officer said, pointing his finger at the camera in a video posted on Chinese social media.

"We are the last generation, thank you," a young man, who is not seen in the video, replied adamantly, in an apparent suggestion he is not planning to have any kids.

The seizure of Dawu Group and imprisonment of its executives is not only an annihilation of entrepreneurship, but an assault on Confucian values of ancestral worship. In other words, the basic family unit is under attack throughout China.

Dawu Group has served the people. It has not been interested in material things or profit. Its wealth is its people. For example, there is no profit in building a 16 story hospital in a village---as it has done---with virtually free medical care. However, it has done that and more.

It had many opportunities to sell its subsidiaries as there were many unsolicited expressions of interest. These entrepreneurs wanted to unlock the monetary value of Dawu Group. These expressions of interest were rebuffed because Dawu Group put people ahead of profit.

One can see from SUN Dawu's analysis in "The Release of Wealth" how others valued Dawu Group from a strictly monetary value. One can deduce why Dawu Group was seized by the government and auctioned off at a discounted value to make a quick profit. The discounted value was less than 14 per cent of its estimated value. It was a steal so to speak.

                                                     The Release of Wealth

People always ask repeatedly, if the company is so big and the company is so extensive then how much is it worth? Some people say that it is one hundred billion yuan (14,503,600,000 US). In fact, the value of Dawucheng is not estimated. Many people don’t understand it. This is a report. You are the boss. How can it be counted? Our company has been developing for more than 30 years, but our wealth is not developed, but released. The value of Dawucheng lies in the wealth it releases. This wealth is incalculable.

We have not borrowed a penny. They are all net assets. Many people don't believe it. How is this possible? The company has three major expenditures, one is taxation, the other is shareholder dividends, and the third is management bonuses of which each account for one-third. We are a farming and animal husbandry enterprise. Many industries not only do not pay taxes, but also enjoy state subsidies. We have very few such benefits.

This enterprise is our family, but we have not received dividends; that is, we receive twice the average wage of workers. With regard to subsidies, this is very small for enterprises; instead, our management takes bonuses, but there are restrictions that they will not exceed five to ten times the average wage of workers. For more than 30 years our companies have earned money in enterprises.

On the other hand, our income continues to grow--especially in the past few years. The company has developed rapidly and has been growing at a rate of more than 20%, so this book number will be large. I don't look at the report, nor do I study it. This number is bigger and it is also a small part of the company's value.

Understand that people do not look at the company's statements and book figures because many companies now rely on bank loans, private loans and blood transfusions. Book assets look a lot, but there is often debt, and there are some debt ratios of more than 90%. For example, Liu Han of Sichuan Province had the right to be powerful, but his corporate assets of about 400 million under the Hanlong Group are also heavily in debt. After he was sentenced to death, the company’s auction was only 300 million yuan, and the debt ratio was also 100 ie. more than 90%. The company assets of a friend of mine in Henan Province are estimated at 600 million, but the debt is as high as 2.4 billion. Finally, the company was insolvent and went bankrupt.

Unlike these companies, our book assets and net assets are real. We did not apply for loans at the beginning of the establishment of the factory. Later, when our own funds could not be spent, there would be no need for loans.

                                                                   Market Price

Speaking of our buildings alone, the construction of Dawucheng is undertaken by our construction company. Can we only calculate the construction cost on the books? For example, the building area of our international hotel is 100,000 square meters. If the value of a square meter in Xushui is about 10,000 yuan then the hotel is worth 10 billion yuan which does not include the hot spring hotel, holiday hotel and hot spring club.

In the past two years, we have moved out production units , agricultural parks, food industrial parks, and 400,000 tons of feed plants next to National Highway 107. Each park has a production capacity of more than one billion. The Group’s top three hospitals have been built. Nine of our buildings have 18 floors. The pensioner apartment buildings have also been built. It can be said that Dawucheng has been under construction, and two thousand construction workers are not working all the year round. How much market value can this generate? How to evaluate it? .

There is also our Dawu brand. All our products are Dawu Brand. It has been used as a famous trademark in Hebei Province for more than 30 years. Some time ago, our winery used “Dawuliangye” and Wuliangye. There was a lawsuit. After contesting the issue for more than two years, Dawu Group had to take it to the Supreme Court. We won the case. I have always advocated: not for profit but for good character, for good products, for making clean money--we have always done this. After years of operation, the brand has a certain popularity. The reputation is intangible, but it is valuable in the market because people trust the brand. However, the specific value of this intangible asset has not been evaluated.

                                                                 Listing value

As early as 2004, there was a US investment company lobbying me to go public. I said, my business is small, can it qualify for listing? The other party said, don't you have 3,000 acres of land? As long as the land is productive one can evaluate the price. One thousand mu (area) needs 16 million yuan, and 4 million yuan as the company's promotional packaging fee. These 20 million are handled by investment companies. Then, an acre of land is estimated at 300,000 yuan, 1,000 acres is 300 million yuan, plus the group's original assets of 300 million yuan is 600 million. The stock issuance price can be set at 6 yuan, then the market value of the group surges to 3.6 billion yuan; if the stock price reaches 12 yuan, the market value will become 7.2 billion yuan; if the brand of the noon is hyped, the stock can reach 15-20 billion yuan.

In the past few years, an investment company in Shenzhen came over to inspect our poultry company and evaluated the poultry company at two billion yuan. It said that the listing can reach 8 billion yuan. How can it generate such four-fold increase? The people in the investment company said that we have the advantage of technology and market: the average laying hen has 285 eggs, but our chicken can produce 325 eggs, and our chicken can sell for more money than the imported varieties of the United States and the Netherlands. The poultry company hatches 400,000 chickens every day. It is still in short supply. Due to transportation restrictions, many markets have not yet been fully developed. After the listing, the incubator has been expanded nationwide. After operation, 80 billion is a conservative estimate. They are very lively, but I am not interested, so I have not taken them to see the Yixian Wanmu Mountain Farm and the original breeder farm of the poultry company, nor have they assessed it.

We don't have the need for financing. We can't spend our own funds. There is no need to go public and it is not in line with our development path to list money and make quick money.

                                                           Wealth password

The wealth of this enterprise is still second. Our greater wealth is Dawucheng. The wealth it releases is our wealth code.

I often say "wealth passwords". The wealth created by enterprises is actually a small part, mainly it is wealth released. For example, the land in Beijing used to be 30,000 yuan for one mu. Now how it has become three million for one mu. Is this wealth created? This is the release of wealth, and the release of wealth is the wealth code.

Is underground oil and coal not wealth? Is jade and gold in the mountains not wealth? If no one is going to excavate it then it is not wealth. Only when enterprises let people go to mine and dig gold can they can become wealthy.

Therefore, if a place’s wealth is to be released, it must be initially supported by the enterprise. This is the introduction and the beginning. After the enterprises are supported, a large number of workers gather here to find employment, live and consume. After the social population gathers, the tertiary industry will rise. At this time, the enterprise is not important. It will improve itself and form a complete flow process. It becomes a society. At this point, its development is unstoppable, and the wealth of this place is released.

The Dawu Group now has 6,000 workers. In the past few years, it has added more than 1,000 workers. These thousands of people have created wealth and they are still spending wealth here. These thousands of people are employed here, their families live here, their children go to school here, the old people are here to support the elderly... consumption is here. Our staff apartment initially sold for more than 1,000 yuan. Now the price in Xushui District is 10,000 yuan. Dawucheng is rated as Kangyang Town. It is a treasure trove of education, medical care and old-age care. Popularity is wealth, so I said that the place to create wealth is not a place of wealth. The place where wealth is consumed is the place of wealth. This is the wealth code of Dawucheng. This wealth is incalculable.

The wealth code is very esoteric. It is not said here. We welcome people of insight to learn from each other.

Is it essential to have a Canadian ambassador to China?

One must expand on and expound on the meaning of the word "essential".  It means absolutely necessary.  If an ambassador to China were essential then we would have one. Canada does not have one. Therefore, an ambassador to China is not essential.

Canada hasn't had an ambassador to China since January 1, 2022. That was the date that Domininc Barton resigned. It isn't the first time that Canada hasn't had an ambassador. We didn't have one after John McCallum was forced to resign on January 26, 2019. In that instance,  we did without an ambassador until September 05, 2019 or a period of seven months.

China has appointed without delay an ambassador to Canada. Maybe Trudeau thinks that is enough. All one has to do is take the advice of the Chinese ambassador to Canada 吧? Those things can be so easily mixed-up even by a Prime Minister. Can't they be mixed-up as easily as Canadian ambassadors to China appointed by a Prime Minister who act like Chinese ambassadors to Canada 吗?

Somehow, now, Prime Minister Justin Trudeau doesn't seem to recognize the importance of a Canadian ambassador to China even if that country has the largest population, the second largest economy and one of the strongest militaries. His choice is either to take the advice of the Chinese ambassador to Canada or appoint a Canadian ambassador to China who acts like a Chinese ambassador to Canada. What it basically means is that if a Canadian ambassador to China is not essential then a Canadian embassy in China is not essential, eh?

China faces 'complex and grave' job market, warns Premier Li

 Laura He, CNN Business

May 9,  2022

One of China's top leaders has painted a grim picture of the job market in the world's most populous nation, as widespread Covid lockdowns slam the brakes on the economy.

Chinese Premier Li Keqiang — the No. 2 in the hierarchy of China's ruling Communist Party — called the employment situation "complex and grave."

Most recent data from the government shows that unemployment hit a 21-month high in March, and that was before China extended the lockdown in the financial hub of Shanghai, and enforced tight restrictions in Beijing. The jobless rate in 31 major cities even surged to a record high in March.

https://edition.cnn.com/2022/05/09/economy/china-li-keqiang-jobs-grave-situation-l-intl-hnk/index.html

https://tradingeconomics.com/china/unemployment-rate

It seems more like a self-inflicted crisis. When so-called "capitalist roaders" are imprisoned, supply chains are interrupted by ZER0-Covid lockdowns, tech industries are forced to lay-off in order to meet more stringent restrictions and inflation erodes purchasing power then how can it be called anything else?

The spraying is an attempt to allay fear, but it has the opposite effect of instilling fear because it is neither an effective means to control SARS nor is it perceived by the public as such.

ZER0-Covid Dynamics Strategy as Preparation for War

The author's view on Beijing's ZER0-Covid Policy or its latest iterration called ZER0-Covid Dynamics Strategy seems to be an unrecognized probability. He has been saying that ZER0 is a preparation for war. It does not mean that there is not another more important reason for the policy such as a political one. The strongest political reason is a third term for the president. However, the affirmation of a third term is a prerequisite for an invasion of Taiwan.

First, consider the language used to fight the coronavirus. It is language used in war. Beijing wants to prevent the spread of COVID-19 to the capital. As a result, the Hebei Daily reports that the province of Hebei has entered a "wartime mode".  Hebei is regarded as a "political moat" to prevent the virus from escaping the province to  Beijing.

At one time---Xiong'an---where Xi's Xiong'an New Area (习的雄安新区) is located, was purposely flooded.  It was done at the time of the Northern Song Dynasty (960-1027). According to Zhang Ling, the Song wanted to create a "Watery Great Wall" to defend its northern frontier from the Khitan nomads. 1.  It was effectively a "political moat".

Today, Hebei has become the "political moat" in terms of ZER0-Covid Dynamic Strategy. Hebei Province  protects the southern border of the capital of Beijing. It so happens that martial law (usually declared during an uprising or war) was declared in Baoding, Hebei on June 15, 2020. Authorities were concerned about the movement of people between Baoding and the Xinfadi Wholesale Market in Beijing (北京新发地农产品批发市场 ).  2.

Second, Beijing has already secured the frontiers in preparation for an invasion of Taiwan. It began with Tibet in the West (occupation) followed by Xinjiang Province in the North (prisons), Hong Kong in the South (suppression of freedom) and lastly Shanghai in the East (ZER0-Covid Policy).  Of course, COVID-19 policies have also weakened the status of Hong Kong and Shanghai as financial centers. This seems to be as deliberate as the campaign to eliminate "capitalist roaders" ie. political  opposition to its authoritarian rule.

The political opposition in Shanghai may stem from former President Jiang Zemin. He was a supporter of Deng Xiaoping's economic reforms. In addition, he was a former Mayor of Shanghai, and subsequently the Party Committee Secretary of Shanghai. "At the very least, Mr. Xi is likely using his failed zero COVID policies in Shanghai as an excuse to clean house both Shanghai’s local ruling cadre and attack the “Shanghai Gang” led by Mr. Jiang." 3.

The Chinese Communist Party's (CCP) 20th National Congress is set to re-elect General Secretary Xi Jinping for a historic third term. His re-election may be interpreted by him as support for an invasion of Taiwan. On October 09, 2021 he stated explicitly that “The historical task of the complete reunification of the motherland must be fulfilled, and will definitely be fulfilled.”

Of course, war is a rather messy affair to say the least. Taiwan could target cruise missiles at the Jiangnan shipyard in Shanghai which is the country's "warship factory". It is here that a Type 003 aircraft carrier is being constructed.

One can say that the Chinese government has used ZER0-Covid Dynamic Strategy  through a rotating series of lockdowns and martial law policies of various degrees to restrict freedoms and exert control over the general population. They have worked out the "bugs" so to speak in application of "thought control". They know now from where the resistance will come. They acclimatize the population to martial law, shortages, check-ups and lock-downs. They instill a sense of self-sufficiency. All of this is done in preparation for an invasion of Taiwan. The government does not want to fight a war on two fronts---namely the foreign and domestic.

While the WHO says that 15 million people (as of May 05, 2022) have died world-wide due to COVID-19; nevertheless, China denies the pandemic started in Wuhan. They deny it began in either the wet market or the Wuhan Institute of Virology. They deny it was released accidentally or by design. They affirm that new cases in Beijing are imported ie. the embassy district is rated China’s only coronavirus “high-risk zone”. They assert that the disease has foreign sources of transmission and origin. Truth is certainly a casualty of a pandemic or preparation for war when it comes to Chinese propaganda.

                                   The Selden Map Revisited

It is probable that a rich merchant involved in the sea trade commissioned The Selden Map around 1618.
In Chinese, it is known as 東西洋航海圖  ('Navigation Chart of the Eastern and Western Oceans'). On the other hand, it may have been John Selden himself. The map depicts trade routes in the South Sea. However, D. Carlton Rossi has examined the map from the perspective of a poet. He sees images that are in a constant state of flux reflecting a Daoist philosophy with the exception where territory and boundary are together to be politically fixed. If the territory is not fixed but rather floating with respect to a boundary then it is more eastern with respect to its characteristics.

The poet's views of The Selden Map have evolved over the last six years since his original analysis. They have changed principally in three aspects. First, he now regards Lake Baikal not only as the North Sea (as designated in the Han Dynasty), but more importantly as "The Closed Sea" as envisioned by Selden. Secondly, he differentiates between changes over a seasonal period of time and equinoxes based on solar declination which correspond to the territorial boundary pairings of Crowned Bat-Kun and Bat Boy-Peng respectively. Thirdly, he adopts and applies the views of Berkowitz concerning border and frontier.

John Selden was a polymath. As part of his many talents he can be regarded as an orientalist. It seems there is stronger evidence today (since the poet's initial analysis) to suggest that John Selden commissioned The Selden Map and may have played a role in things that were added to a standard map--including trade routes. While historians see mountain ranges, lakes and flora in the Northwest corner of the map, the poet sees a Crowned Bat and Kun.

Picture
Crowned Bat

The Crowned Bat is at the location of what may be Lake Baikal where Chinese troops fought in the mountains against troops of the Xiongnu Confederacy in order to defend and extend the frontier.  As early as 101 BCE an historian refers to the lake as (北海) which means  North Sea or Beihai. The poet believes that the map was commissioned by Selden to illustrate an example of The Closed Sea (Mare Clausum) as described in his treatise as well as the Open Sea known as the  East Sea. At the time, the Ming did not distinguish boundaries to an exact degree in the East Sea.

Picture
Baby Bat
Picture
Boy Crowned Bat

It is believed that either John Selden associated himself with the Crowned Bat or the artist portrayed him as such. Of course, the possibility exists that John Selden was the artist. It is not the only bat image in that part of the map. Other images show four developmental stages of his life from cradle to grave reflecting phases of the Moon.

The Crowned Bat symbolizes changes on a seasonal basis. For example, in the colder months it hibernates upside-down from the roof of a cave where it lives in a dark environment. There are many species of bats in caves around Lake Baikal. In the warmer months, the bats leave their caves at night to forage for insects under one or another phase of the Moon.

Picture
Kun or specifically Yukiang Descending

Image of Yukiang descending or decreasing  ie. whale with bird tail diving or perhaps a Chinese kuan which is shaped like a whale with human hands and feet or a white whale swallowing Jonah

In the Northwest corner of the map is found the Kun. It is attached to the left side of the Crowned Bat as it faces the reader. That explains why the poet initially called the pair of images as the Kun, but he now wants to differentiate them. The white Kun is descending. One might say that it is descending or decreasing gradually from Summer Solstice to Winter Solstice or a few minutes everyday.

The local Buryat people of Lake Baikal tell of  a mysterious sea monster which is a Water Dragon Master. Its name is Lusud-Khan which may pay homage to Ghengis Khan who is said to have been born on Olkon Island of the lake.  The monster may be a giant sturgeon.

Picture
Crowned (Cottage?) Peng

In contrast, the Peng which wears a special crown is found on the coast of the traditional East Sea. Specifically, the poet locates the Peng at Telin 特林 on the right bank of the Amur River. The river snakes like a Water Dragon which soon empties into the East Sea. It was here the Ming emperor set up a frontier post in 1409 at Tèlín. The Peng  flourishes in the warmer season of the North. It lays its egg in the Spring and there is a representation of such an egg symbolizing the Peng ascending.  It is associated with sunny weather and the image of the Sun.  In the colder winter it migrates South.

One may  regard the Crowned Bat-Kun (CB-K) and Bat Boy-Peng (BB-P) pairings as representations of change in Daoist philosophy as they pertain to seasons and equinoxes or in a general sense to nature. However, they may also be seen as political territory and boundary pairings on The Selden Map with respect to ownership. In this respect, if they are together for awhile then territory becomes boundary and ownership is feasible. It may be fixed for a time in terms of sovereignty. However, if frontier is apart from boundary then sovereignty cannot be established, but ownership claim is more or less floating.

Abraham Berkowitz says that Selden applied Rabbinic, jurisprudential concepts to international law of the seas. Selden postulated that the seas could be marked with arbitrary, territorial boundaries. Berkowitz argues it was Selden's belief that "sovereignty becomes possible only when frontiers become boundaries". Rossi applies this framework to illustrate boundaries and frontiers with respect to a closed and open sea as are seen on The Selden Map.

The poet now recognizes that Lake Baikal is "The Closed Sea". The Crowned Bat resembles a territory on land while the Kun represents a boundary on the sea. Since they are together side-by-side then the frontier becomes a boundary. Therefore, the "Crowned Bat-Kun acts as a territorial, northern  boundary marker of China. The Crowned Bat-Kun also marks part of the western boundary of the Ming as defined by the West Sea, but another frontier extends further westward along The Silk Road.

Picture
Horizontal Line extending West to East through Compass Rose

One can imagine an horizontal line extending eastward from Crowned Bat-Kun to  Bat Boy-Peng. The Peng boundary is on the right side of the Amur River where it comes out of its loop to meet the Amgun River before it proceeds to the East Sea. Bat Boy is equivalent to Tèlín which may be regarded as the frontier where the Ming Nurgan Regional Military Commission was established in 1409.

Picture
Bat Boy
Picture
Peng

Bat Boy is found on the back of the Peng having been hatched from the egg of Peng (bird).  Bat Boy and Peng are paired to make Bat Boy-Peng which  means they mark the northern territorial boundary of the Ming.  In other words, at this location, frontier becomes boundary so that sovereignty may be claimed.  It so happens though that Bat Boy-Peng also is also  part of the eastern, territorial boundary of the Ming which is defined by the East Sea.

It seems that Bat Boy was actually born on the east coast of the Ming Empire as it meets the East Sea as is recorded on The Selden Map.  Modern scholars designate it as Selden's because he bequeathed it to the Bodleian Library. Scholars of antiquity pretty well ignored it for hundreds of years. Modern scholars do not explicitly suggest that Selden might actually have used the map in his scholarship as a cartographic model of a Closed Sea as he was writing Mare Clausum.

Picture
Stone Egg representing Sanzhang's Head

Bat Boy was hatched from a Peng egg. He might have become Sun Wukong (孫悟空/孙悟空) or the Monkey King with supernatural powers had he been hatched from a stone egg. The Monkey King wore a Golden Fillet on his head to rein in a disquieted mind.

However, Bat Boy was hatched from the Peng's egg as an enlightened human with superior intellect. In time, he became one with the Kun, too. Eventually, he harmonized the CB-P and BB-P pairs through a line running from the center of CB-P to the center of the "compass rose" and onward to the center of the BB-P. This line had its counterpart in the heavens. He wore a bat crown which led to him being called Crowned Bat as an adult. He is a kind of Underground King representing intellect and reason in contrast to an authoritarian, hereditary ruler.

Picture
Kǔyí Island or modern day Sakhalin

While Tèlín was a frontier which becomes a  boundary allowing sovereignty to be estatablished, in contrast, Kǔyí remained a frontier on the almost boundless water. It resembles a striped fish (Kun) which is descending on The Selden Map. To confuse matters somewhat, it also resembles a chicken (bird) ascending in the reverse. They are going in opposite directions! One may say poetically that the island is floating in the East Sea. As such it represents change and flux which are typical characteristics of the  frontier at least from the perspective of the Ming.

The Ming Dynasty placed Kuyi (苦夷) or Kuwu (苦兀) also known as modern day Sakhalin Island under administrative control while the Manchu-Qing Dynasty turned it  briefly into a tributary. It was foreign and not part of Chinese territory. Instead, it was the village of Tèlín 特林 which officially marked part of the eastern territorial boundary of mainland China--not Sakhalin or for that matter Taiwan.

The East Sea and the South Sea were virtually open for international trade during the Ming. They were both open seas at the time Selden wrote Mare Clausum. The main interference with openness was not the Ming regime which encouraged trade but rather with pirates who at this time were mostly Han Chinese with a frontier mentality.

Kǔyí is not under sovereignty of the Ming empire. This means that the East Sea between Tèlín and Kǔyí is an open sea. Kǔyí itself is a barbarian territory from the perspective of the Ming.

Basically, the poet has suggested that there are more images on The Selden Map than are recognized by historians. Some images curiously resemble Selden himself. As such they may be clues to his formulation of concepts on The Closed Sea. It seems that the map provides him a means to examine territories and boundaries in a more objective way as they contrast with Grotius' views of "The Open Sea", but in a less politcally charged way than on  the European continent.

To summarize, the Crowned Bat-Kun pair and the Bat boy-Peng pair may be viewed from an eastern philosophical and poetic perspective with respect to seasons and equinoxes which represent change. However, more importantly,  they illustrate Selden's political viewpoint on territories and boundaries. Territories may become boundaries which are fixed at these locations at least for a time;  as such, sovereignty may be established. If a frontier is beyond a boundary then sovereignty cannot be claimed as territory is in a state of flux.

During the Ming Dynasty, at the time Mare Clausum was written and perhaps The Selden Map drawn, the territorial boundaries of the empire formed a rectangle. The closed North Sea marked the northern territorial  boundary, the closed West Sea marked the western territorial boundary, the eastern territorial boundary met the open East Sea and the southern territorial boundary met the open South Sea. Beyond the territorial boundaries of the empire are the frontiers which are in a state of constant change. The model is beautifully symmetrical.

Trial of SUN Dawu in October 2003

                                 Seventeen Year Periodic "Circadian Rhythm"

One might say that the period of opening up and reform on the macro scale and the common prosperity of Dawu Group as a private enterprise on the micro scale represented a kind of Paradise. However, the fall from grace for Dawu Group took place with the arrest of Sun Dawu and his two brothers on May 27, 2003. Arrest represented Hell. Purgatory began in prison and lasted until November 11, 2020 when all legal details were finalized. Paradise was revisited with freedom of the individual and group. It was reached in the establishment of the Private Entrepreneurial Constitutional System in 2004 which was a type of constitutional monarchy.

       敢言民企老板遭抄家 警方拘捕30人恐涉黑入罪 - 万维读者网 2020年8月4日

Over the years, there were many trials and tribulations faced by the Group due to property disputes of a historical nature going back to the 1950's and more recently to an intellectual property dispute resolved at the Supreme Court. The main dispute though was between Dawu Group and Xushui State Farm which is only an organ or agent of the government; so, its actual ownership is unclear. The dispute involved land. However, despite these  disputes it is indisputable that common prosperity was achieved by 9000+ employees of Dawu Group through a system that emphasized people rather than profit.

The year 2020 resembled the year 2003 in some respects. One similarity was the emergence of atypical pneumonia in southern China. It was classified as SARS-CoV-1 during its emergence in Guangdong Province in November 2002 and SARS-CoV-2 as it emerged in Wuhan perhaps in November of 2019.  The initial government response in both cases was deceit and denial. It treated diseases as a political issue; for example, it organized neighbourhood committees as it had utilized them to control political dissent during The Cultural Revolution. People were afraid of the disease, but the government was more afraid of losing control of the people.

It is no coincidence that Sun was arrested as the disease hit Beijing in May 2003 and also after the evolved virus struck the Xinfadi market in Beijing and and then Baoding which is 150 kilometers southwest of the capital.  Martial law was declared in Baoding and a wartime mechanism was imposed by the epidemic response center.

Today, the government restricts visits of lawyers to SUN Dawu on the excuse of SARS-CoV-2. However, it is more concerned how peasants, farmers, entrepreneurs and even intellectuals of China are influenced by the man considered to be the moral conscience of the nation.  Incarceration merely strengthens the people's trust in The Great Noon (伟大的正午).
The author's own sobriquet for him is "Twelve O'Clock High" (十二点钟高) as in the movie of the same name.

The re-descent into Hell of the decent SUN Dawu and Dawu Group began with two protests reflecting its relations with Xushui State Farm.  Sun has characterized it as a "Freak Farm".  They were known as the 6.20 and 8.4 incidents in the summer of 2020. By themselves they were not very important as they historically involved only 740 mu of land, but their influence was magnified as they are representative of land disputes throughout China.

The incidents were special, too, in that they are responses to land laws enacted in the commune era of Mao dating back to The Great Leap Forward in 1958. They haven't yet been adequately solved by any CCP government. Therefore, who is to blame for the incidents?  It's almost an example of "original sin" of the Party as opposed to its propaganda which emphasizes "original sin" of the peasants. Peasants like Sun--and Sun still calls himself a peasant even if he is a billionaire-- commit no sin when they set up a grain bank in 2003 at Langwuzhuang to maximize and stabilize the income of farmers nor did they commit any sin when they prevented thugs from leaving who provokingly demolished a Dawu building in the August 4th incident of 2020. Sun does admit though that he made some inappropriate comments which he regrets in the aftermath of the incidents.

As a guide to the reader it may be said by the poet that Dawu Group entered Hell around midnight on November 11, 2020. Six busloads carrying 300 submachine-gun toting police and their dogs were dispatched. One can infer that the purpose was to instill terror.

The main difference though between the 2003 and 2020 arrests was in degree. In 2003, SUN Dawu was actually lured outside of the area to the Hongyan Hotel  in Xushui City through a dinner invitation from a newly appointed  county-party secretary. 10. The arrest was done in the light of day by plainclothes officers. If the poet recalls correctly there were many plainclothes police and unmarked cars that arrived during the day at Dawu Group in order to mop up and about 20 employees were detained. However, in the 2020 raid, The Great Noon was arrested along with about 30 senior Dawu officials by police in full tactical gear at midnight. The actions in 2003 were intended to instill fear; although, in retrospect, SUN Dawu described it as an atmosphere of terror. 10.  The actions of November 11, 2020 were intended to instill terror. There is a saying by an unknown poet that reads as follows:

"When the use of fear fails
then the abuse of terror trails"

Picture

One might compare the fear and terror used in the Dawu arrests in 2003 and 2020 by contrasting the use of fear and terror in the The Great Leap Forward (1958-1962) and The Cultural Revolution (1966-1976). The Great Leap Forward (大跃进) was a disaster in that it caused The Great Chinese Famine (三年大饥荒) from 1959-1961 which killed between 15 and 55 million. While terror was a factor in The Great Leap Forward it would seem that fear was the dominant emotion instilled in the peasants. Generally, people died slowly of starvation. They feared death through starvation.  Of course, there were many individual exceptions such as scholars who experienced terror.

Picture

However, one might say that terror was instilled in the Chinese population in the early stages of The Cultural Revolution (文化大革命) 1966-1976.  The first stage of mass killings began with the Red Terror (August-December 1966).  For example, it did not concentrate on poor peasants, but rather rich peasants along with four other black categories as well as "capitalist roaders" in the Party.  In Qufu or the birthplace of Confucius, the graves of the Kung family were dug up by the Red Guards (红卫兵) led by TAN Houlan in order to Annihilate the Kung Family Business (歼灭孔氏家族企业) 2. The takeover of the Confucian, Dawu Group (大午集团) in 2020 is its equivalent in what might be called Cultural Revolution 2.0 with its campaign to Annihilate the Dawu Family Business (歼灭大悟家族企业).

Seven of the innocent defendants which included Sun -- who were presumed guilty until proven innocent --- were transferred to RSDL under jurisdiction of the Baoding municipal Public Security Bureau (PSB).  RSDL stands for “Residential Surveillance at a Designated Location”. This means they had no fixed residence. This is unbelievable because the poet has visited SUN Dawu in his residence and listened to the words of Xi Jinping at the time of the national holiday. Now, the PSB is saying SUN Dawu didn't live there. They hastily converted a structure to a new RSDL in Baoding to inflict torture.

Normally, RSDL is temporary in nature. For example, it may last three months. However, it can be extended as it was in these cases. The duration was extended several times. It appears to have lasted from November 11, 2020 to at least July 25, 2021 or the last day of the trial. "The PSB took advantage of the law with ill-intention, and nullified the human rights protection statute by designating jurisdiction." 3.

The defendants asked to be able to transfer from RSDL or Hell to a detention center because they said  under RSDL they were being tortured. SUN Dawu stated "During RSDL, I once requested to be transferred to the detention center because my treatment produced misery beyond words and life was worse than death. I went on a hunger strike for three days." 4.   All defendants said "life was worse than death". 6.

The defendant Ji Weilian ( 纪玮莲) said "I could see that there were once windows in the Residential Surveillance at a Designated Location (RSDL) room. I applied to change rooms, I was extremely agitated, and wanted to dig out the window. I wanted to open the door. I wanted air. I was interrogated too many times. My memory was declining." 5.

The RSDL was specifically constructed for the defendants of Dawu Group. They can hardly be called residences as there were no windows and no ventilation. The "formaldehyde level severely exceeded safety standards." 6.  Formaldehyde is  known to be a human carcinogen based on "higher risks of nasopharyngeal cancer and leukemia". 7.  It is also used as an embalming fluid for the dead.

In other words, terror of the arrest was transforming into torture through RSDL for the defendants.  Torture became a tactic of terror.  During The Cultural Revolution the paramilitary organization called the Red Guards used torture through brutal struggle sessions. For example, on August 23, 1966, SHU Qingchu known as Lao She who was a communist party member and 20 other writers were transported to Beijing’s Temple of Confucius where a mob of 150 teenage girls beat them with bamboo sticks and theater props.  8.

The actual trial started on July 15th and lasted until July 25th 2021. It can be said that this was the eighth circle of Hell for the defendants. They were faced by those who claimed that the trial was open, but the visitors invited by those facing trial could not be seen. Each defendant was allowed only one visitor who was held in another room. SUN Dawu himself stated “All my family members had come, including our in-laws and other relatives, as well as employees, where are they? I want to know: Is this an open trial or not?” 3.  Secondly, in the 2003 trial there were photographs allowed of the defendants which were published. No photos were allowed in the "open" court of 2021 to  be published. Lawyers  requested that judges recuse themselves on the ground that the court hearing was not truly public. The operative word there is "truly".

The Circle of the Falsifiers

Canto XXIX    Hell      Divine Comedy         Dante Alighieri

With points of thrilling pity, that I clos'd
Both ears against the volley with mine hands.

Together; such was here the torment: dire
The stench, as issuing steams from fester'd limbs. 9.

The outcome of the trial was never in doubt. If ever there were a predetermined result it was in the Gaobeidian Municipal Court. For example, the Dawu Group itself was on trial. However, before the trial, government working groups took over operation of the company including company seals and financial affairs. The trial and sentence merely legalized seizure and control of the company by the government. SUN Fushuo (youngest son of SUN Dawu) has not been allowed to return to his position even when he completed his sentence on September 29, 2021. He and his family are invited to Canada as the poet's guests.

While SUN Dawu has risen from Hell he may be trapped in Purgatory for 18 years. He might get an opportunity to appeal his sentence if ever again allowed to see his lawyer. SARS-CoV-2 is used as the excuse to isolate Sun. Will Purgatory reform SUN Dawu?  Perhaps, if he is allowed to read "Thirty Lectures on Socialist Thinking" by Xi Jinping which he was prevented from reading in Hell while he awaited trial.

One expects though that the real impact will be on the Chinese people. They may finally realize that the same thing could happen to any one of them. If they do not have the protection of lawyers, law, police and Party then who will protect them?

Purgatory where SUN Dawu was briefly incarcerated  is called Baoding Prison or should one say the whole city of Baoding (保定) itself? The poet may have visited Baoding a hundred times for various reasons. However, he found no reason to stay for more than a few hours. It is one of the most heavily polluted cities in China.

It seems though that Baoding Prison was a little too close to Langwuzhuang or Sun's birthplace for the comfort of local authorities. They wanted to get rid of him as far away as possible from potential support. The capital of Hebei or Shijiazhuang which is hundreds of miles away was too close. They went further south to a prison in the Tangshan Guye District of Xingtai (邢台);  so, having spent a year in detention he will spend 17 years in prison.  Xingtai is almost on the southern boundary of the province of Hebei. The poet has passed through Xingtai by bus and train on his way from Anyang, Henan to Langwuzhuang Hebei, but again, it is no place to linger.

Picture
Original Illustration for Bleak Hous

Xingtai is reminiscent of industrialized London in the  mid-nineteenth century. London is described by Charles Dickens (查尔斯·狄更斯) in Chapter One (The Chancery) of the serialized novel Bleak House (荒凉山庄).

Picture

"Smoke lowering down from chimney-pots, making a soft black drizzle, with flakes of soot in it as big as full-grown snowflakes—gone into mourning, one might imagine, for the death of the sun." 14.

The pollution in Xingtai is not the only environmental problem. In the Spring,  large sandstorms blow in from the Mongolian steppe. The worst sandstorm the poet ever experienced was in Linyi City when his face and larynx were literally sandblasted.

Picture
Xingtai Earthquake

There are few who don't know -- which includes authorities -- that this super-sized Purgatory is prone to earthquakes. Xingtai, Hebei is located above the North China Seismic Belt. "The frequency and intensity of earthquakes here are second only to the Qinghai-Tibet Plateau". 12.  From March 8th to March 29th in 1966 the Xingtai earthquakes (邢台大地震) struck and killed 8064 people. 13.  Fate will dictate whether you go out with a bang (earthquake) or a whimper (pollution) in the Purgatory of Xingtai.
Picture
Emperor Gaozu of Han

SUN Dawu may take some solace in the lessons that real history provides. The Battle of Julu (鉅鹿之戰) 13. was fought at Xingtai in 207 BCE between forces of the Qin dynasty and the insurgent state of Chu. The battle provided a decisive victory for the rebels over the larger Qin army. Furthermore, it allowed for the rise of Liu Bang (劉邦) who was born into a peasant family. He reigned from 202-195 BCE as the first emperor of the Han Dynasty. 16.  It was a dynasty that lasted 500 years.

In summary, there are two key 18 year periods of three phases each for Dawu Group and its founder SUN Dawu which may be broadly summarized. In period one, Dawu Group is founded. This may be equated with Paradise as barren land becomes fertile. However, Hell begins with the arrest of SUN Dawu and his brothers on May 27, 2003. It is followed by Purgatory until the official settlement on November 11, 2003 for time served.

In period two, Paradise begins for the Sun family and Dawu Group with the release of the Suns and establishment of normalcy at Dawu Group. The fruition of Paradise is the creation of the Private Entrepreneurial Constitutional System in 2004. The company continues to grow and its employees prosper. However, there were several major setbacks which included two trademark cases, African Swine Flu, seizure of apartment buildings and later two land disputes in 2020.

It may be said that there was a descent into Hell on November 11, 2020 in the detention of Dawu employees which included SUN Dawu and the seizure of Dawu Group. Seven employees including SUN Dawu were removed from their residences and then designated without residence. Life in “Residential Surveillance at a Designated Location” is Hell. The defendants are consigned to Purgatory in their sentences on July 28, 2021.

Sun is sentenced to 1 year in the detention of Hell and 17 years in Purgatory for pleading not guilty. The verdict implies that he has learned nothing in the last two periods of from 1986 to 2003 and then from 2003 to 2020 respectively. The open question though is what have the Chinese people learned from the imprisonment of SUN Dawu, the seizure of Dawu Group and their own situation within the Cultural Revolution 2.0 of fear and terror sponsored by the State.  Perhaps the unintended lesson is that revolution is the solution.

"Annihilate the Sun Family Business" (歼灭太阳家族企业) is part of The Cultural Revolution 2.0.  A multi-million dollar business based on Confucian principles is annihilated for the equivalent of $US 32 scrap value in the “8.4事件” (also known as the August 4th incident).  Local officials have metaphorically tried to bury alive SUN  Dawu in a prison cell very far away.

Picture

"Annihilate the Sun Family Business" (歼灭太阳家族企业) is similar to "Annihilate the Kong Family Business" (消灭孔氏家族企业) during The Cultural Revolution in 1966 when property was destroyed and "capitalist roaders" were persecuted. To remind you, Kong is short for Kongzi or Confucius.  In a three day nihilistic orgy,  the Red Guards tried to dig up Confucius so that they could burn his bones.

ZHOU QING: THE BACKGROUND OF THE SUN DAWU INCIDENT-AN EXCLUSIVE INTERVIEW WITH SUN DAWU AFTER HE WAS RELEASED FROM PRISON [2003]

2021 year 07 month 18 day 7: 33

Zhou: Can you talk about why you want to make your business small, slow, and solid?

Sun:  So great companies do not stem from great ideas. Enterprises, especially large enterprises, cannot aim at making profits, but aim at being a human being and being responsible to society. I feel that a large company does not depend on one of its leaders, but on its system, and on whether it can bring out a group of people, so that it can last.

Zhou: Please describe the future of Dawu City?

Sun: The Dawu City I talked about is a harmonious concept. There must be rich and poor here, but this difference is only reflected in the means of production, not in the means of subsistence. Everyone is equal in dignity and lives. There can be few differences in quality, and there is a peaceful relationship between people.

SUN:  "I have played down the words fame and fortune. I have no ambition or selfishness. I am thinking about how to bear more social responsibilities. It is an entrepreneur who is concerned about the country and the people, and an enterprise is for the country and the people. Family spirit. If I have the opportunity, I hope to reflect to the central leadership. I want to tell him that China’s problems, especially the three rural issues, are easily resolved, and I will tell him my feelings. The problem of Chinese farmers has not been solved before, and I hope he can solve it."

左到右 Left to Right:   孙萌 SUN Meng,   刘平 LIU Ping,   孙大午 SUN Dawu,   孙二午 SUN Erwu,   孙福硕 SUN Fushuo   (2013 年 2 月 24 日  February 24, 2013)

Sun Dawu served the people as Chairman of Dawu Group for 35 years.  In his early career, he served his country in the 82nd Division of the 28th Army Group in Linfen, Shanxi Province.

                                                  Outsiders and Insiders

An article published on Weibo at the time of the sentencing of Sun Dawu is perceptive in that it expresses an unique perspective of the case. It is written by Junwei Changfeng (军威长风).  On the whole, it compares the cases of Sun Dawu (孙大午) and Ren Zhiqiang (孙大午) who were both sentenced to prison terms of eighteen years. What caught the author's attention though was the contrast between "outside and inside"--meaning outside and inside China. The phrase will be expanded upon by the author with respect to the term "disease" in terms of comparison.

With regard to the Sun Dawu case, he basically says that those outside China today (or more specifically the Great Firewall of China) are concerned with issues of free speech. These issues might be tied, by inference in the author's opinion,  to civil rights. For example, Sun Dawu is someone who speaks out and dares to tell the truth.  In 2015, he expressed support for lawyers who were arrested en masse for  defending rule of law and constitutionalism.

However, it seems that there is at least one topic concerning Sun Dawu that is important to both outsiders and insiders.

Picture
Picture

The issue is African Swine Flu 非洲猪流感 (ASF). Sun Dawu spoke of a government cover-up and he used scientific evidence to back-up his claims. Both outsiders and insiders were concerned about its spread, the government cover-up and its economic consequences. The blog site of Sun Dawu with over a million hits in China was closed down by authorities. They are authorities only with respect to control rather than reason and justice.

African Swine Flu is a hemorrhagic disease that mainly affects swine; although, a few cases have been known among those who handle swine. On the other hand, SARS-CoV-19 is a pulmonary disease that can affect the human population. Linda Saif, virologist and distinguished professor in the Food Animal Health Research Program at The Ohio State University says that "SARS-CoV-2 is part of a third distinct group of coronaviruses (beta CoV) and is genetically and antigenically distinct from these two swine coronaviruses". This means there is no cross-infection between swine and humans with regard to SARS-CoV-2.  ASF originated outside of China while COVID-19 originated inside China probably at the Wuhan Institute of Virology and appears to have spread through the Baishazhou Market.

The reason this is pertinent to the Sun Dawu case is two-fold. First, Sun Dawu was arrested on May 27, 2003 during the SARS epidemic which was centered in Beijing. Then, seventeen years later, a mutated version of COVID-19 hit Wuhan and then Beijing.   Its epicenter was another wholesale, wet market called Xinfadi in Beijing.

Picture

As a result, the city of Baoding, Hebei was placed under martial law on June 15, 2020 because it had trading ties with the Xinfadi Wet Market. To get one's bearing, Baoding is about 150 km from Beijing West Station, 40 km from Langwuzhuang (Dawu Group and 50 km from Xiong'an. Perhaps, more importantly for later developments involving Dawu Group, Langwuzhuang is only about 34 km from Xiong'an New Area or the future, legacy city of Xi Jinping.

Picture

During the summer there were two incidents involving land disputes between Dawu Group and Xushui State Farm which were of interest to those within The Great Firewall. They are termed the June 21st and August 4th incidents  “6.21事件”和 “8.4事件". Simply put, one may surmise that authorities were concerned how minor incidents might become catalysts for major disturbances during a pandemic. To express it another way, Zero tolerance for COVID-19 is mirrored in Zero tolerance for even minor, land disputes.

Seventeen years earlier, public speeches had been given by Sun Dawu in Beijing at both Peking University and China Agricultural University on March 13th and 14th of 2003 respectively.  They dealt with “The Pathetic State of Chinese Farmers” 《可怜的天下农民》and “A Voice From the Bottom — Eighteen Years Experiencing the Three Issues of Rural China”《来自底层的声音——十八年感受三农》.

It can be said that the speeches dealt with the general plight of farmers. The government criticized how the issues were expressed in a public forum. The government was also upset that similar viewpoints had been delivered earlier in a private forum at Zhongnanhai where they had invited the speaker to express his views to policy makers.

The government at the time was concerned how peace and harmony might be upset as the SARS crisis developed in 2003. Therefore, local authorities under direction of higher authorities decided to arrest Sun Dawu in order to nip in the bud any future,  speaking incidents either there or elsewhere before they spead and were magnified in intensity.

While the arrest of Sun Dawu in 2003 came by surprise it might be said that his arrest in 2020 was somewhat predicatable because of SARS-CoV-2;  afterall, land disputes are potentially much more volatile than speeches alone. There may be a couple thousand land disputes in any given year throughout China. They are basically a legacy of policies of The Great Leap Forward and Cultural Revolution.

To show how concerned the government was about the Omicron version of COVID-19  it "reframed" its plan for Xiong'an New Area (雄安新区). This was done on September 09, 2020 which is coincidentally two months before Sun Dawu's arrest at Langwuzhuang, Hebei.  Xiong'an's self-sufficient city would now consist of self-sufficient units. In doing so the goal was to create a "COVID proof city".

Picture

Anyone knowing the situation in health care services at the self-sufficient village of Langwuzhuang (郎五庄) might have thought the plan of a "COVID proof city" to be ridiculous if not ludicrous. Dawu Group had built a hospital of 17 floors for its nearly 10,000 employees. The emphasis was on first-class treatment. The monthly fee to employees was only 1 yuan (US$0.15) a month, so, basically it was subsidized by the Group. It was expanded to include residents of Langwuzhuang who were not employees. If there were a misdiagnosis then the patient would be financially compensated. In addition, one hundred medical staff had voluteered to go to the front lines of Wuhan during the COVID-19 crisis in March 2020---the CCP didn't want the help.

In general, the Dawu model of health care (which is part of a larger social protection network) is immensely successful. It is a model for all hospitals and could become a key cornerstone of socialism throughout China. What patients fear in China is not the disease, but the fees which can bankrupt them. What the government fears is the disease because it means potential loss of control. For example, Omicron's evolution is faster and potentially more pervasive than any planned revolution with respect to internet of things, 6G or AI.

Picture

Presumably, the reframing of Xiong'an as a "COVID proof city" of the future further strengthens China's COVID policy of Zero Tolerance. As the days go by, though, this policy seems to be more about control of the individual than the disease. It seems the "future" has arrived sooner than expected for the government. Xiong'an was locked down under "stealth martial law" at the end of January 2022 when five cases were recognized. Five cases of Omicron meant 1.2 million people were locked down for an indeterminate period.

In summary, Junwei Changfeng's observation of the perceptions of outsiders and insiders is valid. Generally speaking, "outsiders" beyond The Great Firewall are concerned about issues involving free speech in China (as they are in their own countries) while insiders in China who are faced with firewall restrictions are more  concerned with legacy land issues.  In contrast, issues concerning disease are more universal especially when they become world-wide pandemics as in the case of ASF and SARS or SARS-CoV-2.

Specifically, with regard to Sun Dawu, outsiders and insiders were more concerned about free speech in China both before and after his 2003 arrest.  Seventeen years later, "outsiders" continued to focus on free speech and secondarily on property bubble issues which have spread world-wide. Land issues and disputes arising from them became the dominant theme for Chinese "insiders". For example, minor land issues surfaced in two incidents at Langwuzhuang in the summer of 2020 which garnered national attention before Sun Dawu's arrest several months later.

In both 2003 and 2020, SARS and its mutated version called SARS-CoV-2 respectively had hit Beijing itself which alarmed the government because legacy land issues had not been solved throughout China and are now compounded by a related bubble in the property sector.  In other words, peasants and farmers have lost land to the property sector in the cities. To survive, the sector needs to acquire more land through dubious means and low compensation in order to maintain growth. It is a vicious cycle.

                                                  The August 4th Incident  8.4事件

On August 04, 2020, the discord between Dawu Group (大午集团) and Xushui State Farm (徐水国营农场) came to a head.  The "Minutes of the Public Security Bureau [2020] No. 1 Meeting of Xushui District Public Security Bureau of Baoding Municipality"

and other documents suggest prior coordination, planning and preparation (behind the scenes between various authorities) for the demolition of the mobile structures and fence on the Dawu property which was to take place at 5:00 am.  The whole scheme resembles entrapment.

A small enclosure and fence were surreptitiously demolished at the Dawu Group property. Dawu Group employees prevented the perpetrators from leaving. Dawu Group employees conducted a peaceful protest which led to what was called the August 4th incident involving a confrontation with police.

The value of the light structure and fence was 18,000 yuan or $US 2843. One might consider the act of demolition to be malicious mischief. No perpetrators were arrested.  One might guess the recycling of the scrap was about 200 yuan or $US 32.

Ultimately, the August 4th incident lead to the detention of 7 employees who were tortured under RSDL. Nineteen Dawu employees were formally arrested and then sentenced on serious charges ranging from one to 18 years. The founder--SUN Dawu--received the longest and most harsh prison term.

The incident also led to the complete seizure of Xushui District's second largest employer under the guise of protective stewardship. The business had begun 35 years earlier. It is difficult to say how many employees have been laid off, but some reports suggest the number to be at least 3000.

"Annihilate the Sun Family Business" (歼灭太阳家族企业) is part of The Cultural Revolution 2.0. A multimillion dollar business is annihilated for the equivalent of $US 32 in scrap value. It is similar to "Annihilate the Kong Family Business" (消灭孔氏家族企业) during The Cultural Revolution in 1966 when property was destroyed and "capitalist roaders" were persecuted.

Zhang Dewu, Chairman of Hubei Xiangda Agriculture and Animal Husbandry Group

January 26, 2022

Paradoxically, Zhang Dewu's Xiangda Group, like Sun Dawu's Dawu Group, was severely sentenced by the grassroots court for  "picking quarrels and provoking trouble".  Zhang Dewu was sentenced to 13 years in prison, and Sun Dawu was sentenced to 18 years.

The Zhuxi County Court, the presiding court in the Xiangda case, found Zhang Dewu guilty of picking quarrels and provoking trouble, illegal detention, bid rigging, loan sharking, and gathering a crowd to attack state organs in Tuesday's judgment. He was imprisoned for 13 years and fined 60.13 million yuan.

Zhang Dewu and several leaders of Xiangda Group were detained by the police at the end of 2019 because of this case. According to China's "Caixin.com" report, at the end of 2020, the Zhuxi County Procuratorate had included the crime of participating in a triad organization when prosecuting the case, but when the case was re-indicted in August 2021, Zhang Dewu's "organization and leadership of an underworld organization" Crimes” and other crimes related to gangland were cancelled. This seems to give people hope.

However, on the day the verdict was handed down, Xiangda Group issued a statement expressing dissatisfaction with the verdict: "The management of the group disagreed with the fact-finding of the first instance, the application of the law, and the proceedings, and felt that Mr. Zhang Dewu was severely sentenced in revenge after he was "picked". Outrage, regret."

According to Caixin.com, Zhang Dewu's defense lawyer, He Bing, a professor at China University of Political Science and Law, pleaded not guilty to all the charges charged by the local procuratorate during the trial, but it was not accepted by the court.

Hubei Xiangda Group Applied For CCP Takeover

On June 2nd, a letter of request from a well-known private enterprise in Hubei, Xiangda Group, for a government takeover has sparked a hot debate!

Xiangda Group has been ranked among the “Top 500 Private Enterprises in China” by the All-China Federation of Industry and Commerce, with over 7,100 employees, and has been included in the government work report of Yicheng City for 14 consecutive years. In recent years, it has ranked 7th in the industry with an annual production of 2.5 million live pigs.

According to the daughter of Zhang Dewu, the Chairman of Hubei Xiangda Group, her father is being persecuted by the local so-called task force. She is currently studying for a PhD at the University of California, but had to temporarily return to China to manage the company.

On November 12, 2019, a number of Xiangda Group staffs, including Zhang Dewu, were controlled by the judicial authorities in Shiyan City, Hubei Province (the case is under the jurisdiction of different location), Zhang Dewu and others have been detained since then, and its business has suffered a sharp decline. The company was already in the pre-listing tutoring period and financing expansion was imminent. But by this, the brokerage firm immediately suspended and withdrew!

It is reported that the so-called task force’s mission is to retrial an old court case from 17 years ago.

In February 2002, Yicheng Procuratorate filed an indictment with the Yicheng Court on the charges of obstruction, provocation and illegal detention by Zhang Dewu. After the first trial, second trial and retrial, Zhang Dewu was found not guilty.

In November 2019, a number of defendants were taken away on suspicion of gathering and storming state organs, and were then transferred for review and prosecution as gang-related. A year later, Zhang Dewu’s old case from 17 years ago was filed as a protest.

It is almost unprecedented in judicial practice to file a protest again after 17 years, moreover, the case itself was not serious type of crime.
It is reported that the local Public Security Bureau has illegally frozen 154 million Yuan ($24.13M) production and operation funds of the enterprise. Its practices are no different from robbers!

Following is the letter of request from the Xiangda Group for donating to the government and applying to be taken over.

Why May Unconstrained Power Disrupt the China’s Miracle? /Sheng Hong

October 26, 2021

As for the property rights institution, in recent years, the property rights of enterprises and residents have been violated from time to time, and there is no channel for legal relief. Even the personal safety of entrepreneurs can not be guaranteed. They are often maliciously trapped by the local government and use judicial means to make unjust cases. For example, the Sun Dawu case was clearly a land dispute between Dawu Group and a nearby state-owned farm, which was first provoked by the state-owned farm. However, he was trapped to various charges and sentenced to 18 years’ imprisonment. Another example is that Hubei Xiangda Group took over a chemical plant on the verge of bankruptcy under the guidance of the local government, but the company’s leadership was labeled as a “underworld” due to employee petition (Si Qipu, 2021), and so on. The property rights of ordinary citizens are posed a serious threat due to the prevalence of illegal demolition. In violation of constitutional principles, some administrative departments improperly elevate the so-called “planning right”, so as to deny the constitutional rights of citizens such as housing right, property right and residence right. In recent years, some local governments ignore the restrictions of the Constitution, do not recognize the policies and commitments made by the central and local governments, violate a series of administrative laws and abuse public violence. In 2019, there was a bad situation of driving out the “low-end population” in Beijing; In recent years, there have been a large number of illegal acts of forcibly demolishing residential houses in suburban districts and counties of Beijing, Hebei, Shandong, Hainan and other provinces and cities.

The Cases of Dawu and Dewu

The cases of SUN Dawu and ZHANG Dewu of Hebei Dawu Agriculture and Animal Husbandry Group Co., Ltd (Dawu Group) and Hubei Xiangda Agriculture and Animal Husbandry Group are remarkably similiar. They differ only in location with Dawu Group in Hebei Province and Xiangda Agriculture in Hubei Province. Both entrepreneurs and enterprises initially had trouble with local authorities in 2003 and 2002 respectively. They were taken to court and verdicts were rendered. The entrepreneurs and enterprises were taken to court again in the 2020-2021 period and severely punished.
Basically, the local governments claim that the offenders haven't learned anything in a seventeen-eighteen year period. They continue to "provoke trouble" which is a general catch phrase originally applied to the gay community in the 1990's and then extended to cover other areas including politics. In other words, their re-education and reform has been unsuccessful according to the government. They are repeat offenders who resemble the underworld community.

The result is that the offenders were sentenced to lengthy terms. Their enterprises were seized or effectively seized. Their wealth was confiscated in the name of donations to the government. All of this was done in violation of the constitution.
While China has one of the most beautifully written constitutions in the world it has become obvious it is now not worth the paper it is printed on. That awareness ironically weakens the government whose power rests on the constitution.  It is a toothless tiger or one might say a "paper tiger" in the Year of the Tiger.

I was prompted to comment on the recent auction of Dawu Group after reading an article called "China’s economy facing ‘serious danger signs’ by Greg Robb published on April 18, 2022.

The reader is no doubt aware of the arrest and conviction of SUN Dawu on various charges. The situation resembles the treatment of ZHANG Dewu of Xiangda Group.  However, do you know that Dawu Group has recently undergone a forced sale through auction and Xiangda Group was nationalized?

I remember an essay written by SUN Dawu perhaps four years before his arrest.  It was really in response to several soliciations to purchase various subsidiaries of Dawu Group. The Group has about 28 subsidiaries. The buyers were willing to pay a substantial premium for assets in order to take public those companies. His response was that they were not for sale and that people came before profits. Dawu Group had almost 10,000 employees before its seizure. SUN Dawu was looking at the growth of the the Dawu Group over the next 100 years and not a fast profit over the next business quarter.

10 of 10,000 Questions to think about on the Long March from Mao Zedong Thought to Xi Jinping Thought

1.  How will the forced sale and nationalization of Dawu Group and Xiangda Group respectively; as well as potentially others in the future, affect the economy in the short and long run?

2.  Do the "white glove" Communists who took over Dawu Group put profits ahead of people in the People's Republic of China?

3.  Have Dawu Group and Xiangda Group  been singled out as a lesson to the top tier companies like Alibaba?

4.  Are the white glove, white shirted  and black suited Communists treating farmers with pig farms like pigs?  Is this the new ASF spreading like a virus among pig farmers?

5.  Wasn't there "common prosperity" under Deng Xiaoping that disappeared along with freedom under Xi Jinping?

6.  Wasn't Dawu Group the essence of common prosperity which ended with its acquisition?

7.  Are the empty streets of the financial capital of Shanghai a symbol of "common prosperity"?

8.  If SUN Dawu can be misrepresented as a bandit and gang leader of the past by the government then who is the pirate of the present?

9.  Dawu Group had virtually no debt before the arrests and seizures by state actors;  so, from where did the debt come from except from above like destructive hail?

10.  Since the Chinese government is continuing to pursue a now unsuccessful  policy of ZER0-Covid then wouldn't it be better for it to call the next variant of Omnicron by the nomenclature "ZER0-Covid"?

On November 20 and December 14 of the same year, because of her advanced age and suffering from various diseases such as high blood pressure and diabetes, LIU Huiru had not participated in the decision-making and management of Dawu Group for a long time, and neither illegal nor criminal was involved. For violent crimes, her attorney then applied twice for him to change compulsory measures (that is, release on bail pending trial), but both times she was regarded by the police as “after review, our bureau believes that Liu Huiru may destroy, forge evidence, and interfere with witnesses’ testimony” Rejected by

On December 17, 2020, she was formally arrested by Gaobeidian police on suspicion of "illegal absorbing deposits from the public";

Later, her case was prosecuted by the Gaobeidian City Procuratorate to the Zhigaobeidian City Court; on August 31, 2021, he was finally sentenced to 3 years in prison for the crime of "illegal absorbing public deposits" by the Gaobeidian City Court of Hebei Province in the first instance. November 10, 2023; Two other daughter-in-laws and a niece in the same case were convicted and exempted from punishment.

Where Rights are Wrong and Wrongs are Right

                                                            The Demolition Incidents

My readers may be familiar with a story published on my websites about three years ago. The basis of the story didn't make the national headlines in China because it was a local matter; although, it represents a rather pervasive phenomenon. Several large advertising towers along the highway belonging to Dawu Group were demolished on June 16, 2018 by government departments.

The circumstance reminded the author of his experience at the Graduate School of the Chinese Academy of Sciences (CAS) in 1993. He asked his doctoral students to imagine they were starting up a business in their particular field of expertise. The project was to design a poster which would advertise their business. Out of his own funds he purchased the posters which were to be used.

It was amazing the degree of enthusiasm and skills the students applied to their project. This was magnified because most of the students were in theoretical rather than applied sciences. They actually had to think about the real world and what they might do after they graduated.

Their teacher was quite proud of their achievements. He displayed their posters on the walls of three classrooms. However, he ran out of space. Therefore he also posted them on the walls of the stairwells.

The Party had them all torn down within one-half hour. It may not be called demolition, but it is definitely censorship of free speech. They asked him why the posters had been put up. He explained to them that his kindergarten teacher used the same method. And everything he learned was in kindergarten--especially social skills. They didn't quite know how to respond to that reply.

Dawu Group put up large advertising signs along the highway to direct motorists to their businesses--especially out of town travellers who wanted to find the water park. They asked permission of authorities to put up the signs and they received permission. Another hundred businesses did the same thing.

Yet, one day the government arbitrarily tore down the signs without using legal procedure. They even confiscated property in the same manner. Anyone else-- except those in authority--might regard it as vandalism if not theft. The signs were sold for their scrap steel value. Of course,  the government used a third party so that they could distance themselves from illegal theft. The point is that the distinction between getting permission and not getting permission is blurred because the government can act arbitrarily and even claim legality based on vague laws. However, if the government is teaching its citizenry to act as it does rather than what it says then it may unexpectedly get exactly what it wishes.

One might say that the government's dismantlement of the billboards was predicatable based on two factors. The most important was the Xiong'an New Area 雄安新区 which was established in April 2017. Xiong'an's development is taking place under the direct oversight of the Central Committee of the Communist Party of China and the State Council. This means private signs were sacrificed by the State in the interest of public good as interpreted by the State,  part of a beatification program or for any other reason.

The second factor involves precedent. The city of Beijing had announced on December 17, 2017 that 27,000 illegal signs would be demolished. These were along the 4th Ring Road which was fininished in 2001. The author is familiar with this road because he travelled on it for 45 minutes by bicycle to CAS in Zhongguancun, Haidian District so he could teach a 3 hour class and then returned on the same road in the opposite direction to teach a 3 hour class at CASS in Chaoyang District.

The battle of 4th Ring Road, so to speak, was waged on four fronts; namely, signs, safety, beatification and demolition of homes. Tens of thousands of rural migrants and workers were kicked out of their homes and forced to move back to the countryside. One woman was thrown out of her home, thrown out of a hostel the next day and thrown out of another hostel on the third day.

The dismantlement of billboards in the Xiong'an area in 2018 was also a harbinger of things to come. Billboards are basically signs. However, symbols are much more important.  Dawu SUN, Dawu Group and Dawu City are related symbols. They symbolize freedom, family enterprise, democracy, constitutionalism and moral principles. The three symbols are perceived as threats to the Communist Party because of their proximity to the the Xiong'an New Area.

Dawu City is a socialist, utopian paradise of common prosperity. It is based on goodness rather than evilness. The model encourages people to be good and it begins with the family and earlier with ancestors and rites. On the other hand, the Party's model is top down. It assumes that force is necessary because people are born evil. Of course, it may be said that evil is in the eye of the beholder.

It can be perceived that SUN Dawu is much like Confucius who searched for a ruler to serve. According to a new book called  The Shortest History of China  by Linda Jaivin, Confucius  asked seventy-two different rulers if he could serve them. Ironically, it seems, he also had seventy-two pupils who mastered his thought, but they were not rulers or were they the truly worthy rulers?

Unfortunately for Sun--China has only one ruler. China is ruled by only one thought. It is Xi Jinping Thought. It is a situation reminiscent of the Cultural Revolution under Mao Tse-tung who wanted to preserve Chinese Communism and his own authority by imposing Mao Tse-tung Thought as the dominant ideology.

There is a difference though between Confucius and SUN Dawu with respect to the times they lived.  Confucius lived in the Spring and Autumn period of the Zhou Dynasty. He was   arrested only temporarily because of misidentification. However, if Confucius had lived in the Qin Dynasty he likely would have been persecuted or perhaps executed through burial along with 460 Confucian scholars. The author classifies Emperor Qin Shi Huang's Thought as "Tough Thought".

It was not enough for the Party to establish a committee at Dawu Group. It was not enough for the Party to require  systematic government access to private-sector data at Dawu Group as they have required throughout China. It was not enough to hold a local meeting of the Party at Dawu Group around the time of the trial.

What  was required was the arrest of more than 20 family members and company executives of Dawu Group along with the seizure of the Dawu Group Ltd. What was required was replacement of all 30 managers of the subsidiaries with officials sympathetic to the Party if not outright Party members. What was required was the conviction of SUN Dawu and others on charges of "Picking quarrels" 寻衅滋事 which the author calls "Peking quarrels" even though those quarrels were provoked by organs of the State. What was required by the Party was the Annihilation of the Dawu Group Family Enterprise reminiscent of the Annihilation of the Kong (Confucius) Family Enterprise
捣毁孔家店 in 1966 during the Cultural Revolution.

Demolition of Mobile Building

"The “August 4 incident” specifically refers to a series of collective rights’ protection actions by Dawu Group employees on August 4, 2020, when the Xushui District Public Security Bureau (徐水区公安局) intervened with excessive force in the land dispute between Dawu Group and a state-owned farm.

At the end of July 2020, the Dawu Group built fences and prefabricated mobile houses on the Sijiatai (四家台) lot for farming and management needs in accordance with the land contract signed with Langwuzhuang village (郎五庄).

In retrospect, one can see that the demolitions began outside of the Dawu Group on the highways leading up to it. It involved the destruction of billboards or property owned by Dawu Group which were used for advertising purposes. The company had legal permission to erect those billboards. Dawu Group's staff claimed the demolition was done by government departments. The mayor actually said "Your Dawu Company must support the work of the government!" Basically, the Dawu response was as long as it complies with the law. The author seems to recall that the total loss to the Dawu Group amounted to $100,000 US and the loss to business is incalculable.

On August 04, 2020 another demolition took place at Dawu City. It was a building owned by Dawu Group. The building had been erected a few days earlier. This was done in accordance with a land contract with Langwuzhuang village (where SUN  Dawu was born). However, the building was demolished without notice under a police protective umbrella. While the damage done amounted to only about $3000 US; nevertheless, the demolition was planned in advance as a provocation by an organ of the State. A civil disturbance and resistance ensued. In the immediate aftermath, Dawu Group employees were arrested. No one who was responsible for the demolition was arrested. No police were arrested. All of this resulted in the midnight arrest of the Great Noon (SUN Dawu) and executives of the company by police wielding submachine guns on November 11, 2020.  In effect, the entire Dawu Group Ltd. was also seized by the State.

Mao Tse-tung introduced the concept of "common prosperity" in 1953. In 1958, he visited Xushui District, Hebei Province to better understand the situation of the peasants and to promote the Great Leap Forward. Today, it seems that more understanding of the state-organ known as Xushui State Farm and Dawu Group is required by the national leadership if it wishes to promote "common prosperity" in the rural areas of China.  Is "common prosperity" furthered with the imprisonment of Dawu Group executives and with the local government takeover of a thriving agricultural enterprise which serves the people? Dawu Group is not only now "run" by the local government, but is being "run down" by it.  Is this the model of "common prosperity" for the rural areas of China?  The peasants, farmers and migrants might think differently.  It may be time for another visit to Xushui District by the national leadership if it wishes to follow in the steps of Mao Tse-tung.

                                    The Trial of the Century

Sun Dawu was released from RSDL after 9 months along with six other co-accused. Two defendants under RSDL had irregularly been refused bail which contributed to their suffering even though the law allowed release. Furthermore, it is believed by the author that 3 months is the maximum time an accused can legally be  held in RSDL. It seems this law is circumvented by detaining suspects for an extended period of time before an arrest is made. This circumstance may further erode protective rights of citizens during detainment.

Immediately, upon release, Sun Dawu was taken to the hospital of Dawu Group for observation and treatment for a brief stay of undetermined length; altlhough, it could probably be measured in hours. It is perhaps the best regional hospital and he was examined on the 15th floor. The status of his mental and physical health was unknown publically, but Sun Dawu has said at trial that the circustances of RSDL were tortuous. One could speculate that he was at least debilitated and disoriented.

It is therefore uncertain but probable that he was not totally competent to defend himself at trial. The trial itself was legally public, but de facto secret. One might liken it to a three ring circus ie. all blow and show. Whether or not the trial was intentionally designed to weaken and disorient the defense lawyers and defendants is not known, but that was its effect. Remember that there were 20 defendants who were tried and sentenced in a matter of just fourteen days with hundreds of thousands of pages of evidence submitted. Yet, disclosure of recorded sessions which the defendants demanded to be presented were disallowed by the judge.

One of the few pictures of the trial that escaped the censors was that of an ambulance at the court exit on the final day. It may have been for Sun Dawu, another defendant or defense lawyer. A defense lawyer had complained about the court hours which sometime exceeded fourteen hours and broke labour laws. One might even construe the length of hours and format of proceeding to be tortuous in themselves. Whomever the ambulance was for it is certain that an ambulance ushered in the trial and an ambulance was present at the conclusion of the trial which is rather an infamous and dubious legacy.

Supervisor Sun Dawu was charged with illegal absorption of public deposits, provocation and nuisance, illegal mining, gathering a crowd to storm state organs, illegal occupation of agricultural land, forced trading, disrupting production and operation, and obstructing public service.

With regard to all the evidence in this charge, including audio and video evidence, Sun Dawu provided the following cross-examination opinion: “The Public Security Bureau has used many despicable means to willfully create a wrongful case. The video recording of the scene is the only meaningful evidence, and the rest is not worth refuting. But if they again place me under Residential Surveillance at a Designated Location (RSDL), they will get the same confessions from me, or even worse — they will get whatever they want to get.

Ji Weilian (纪玮莲)
Ji Weilian, secretary of the group office, was charged with the crime of picking quarrels and provoking trouble, the crime of gathering a crowd to storm state organs.

During the trial, several defendants questioned the failure of the judicial authorities to uphold their promises, at the same time filing another application for bail pending trial.

Ji Weilian pointed out: “I don’t understand it: the RSDL room as well as the detention center all have 360-degree rotating cameras. They can clearly observe my physical and mental condition. Why can’t I be granted bail?”

Another defendant in the Dawu case is Ji Weilian (纪玮莲).  A former assistant to Sun Dawu (孙大午), she was also placed under RSDL.  Ji suffers from severe depression.  After being taken into custody, she has been vomiting dozens of times a day.  She is extremely weak and on the verge of mental breakdown.

The defendant Ji Weilian (纪玮莲), who previously was also placed under RSDL and suffers from severe depression, said that she could understand how false interrogation transcripts could be created during residential surveillance. This is because — “Mr. Dawu said that during the RSDL period, life was worse than death. But if you ask me, I say words pale in comparison to reality. During the pre-trial meetings, the lawyers proposed to go back to the RSDL site for on-site inspection. I really didn’t want to go, because I trembled even when I thought about that environment.”

The defendant Ji Weilian (纪玮莲, female) said: I could see that there were once windows in the RSDL room. I applied to change rooms, I was extremely agitated, and wanted to dig out the window. I wanted to open the door. I wanted air. I was interrogated too many times. My memory was declining. The case handlers tried to help me recall the details, but I couldn’t recall them. Everything written in the transcripts was prompted by the case handlers, as evidenced by the interrogation video recording. I had hoped to be taken out of the room to be interrogated, because then I could have a breath of fresh air. When a female member of the custodial caretaking staff came into my residential surveillance room she fainted within 5 minutes. During my final two days of detention, the doctor gave me an oxygen bag, which I had kept on requesting but they they had not given it to me. (Crying.) Why did they seal off the windows that had been there, why? I will keep asking, and waiting, for an answer.

Sun Meng, the chairman of the board, was charged with the crimes of unlawful absorption of public deposits, unlawful occupation of agricultural land, illegal mining, forced trading, and fraud.

Sun Meng (孙萌): “They recommended other companies to me to take over Dawu Group!” Sun Dawu’s eldest son and chairman of Dawu Group, Sun Meng, said: “After I was placed under RSDL, an official came and said that Dawu Group needed someone to operate it and recommended several companies to me to take over the group. I said that those companies were not even in the same industry, how could they take over Dawu? From the perspective of the long-term development of the company, my father should be granted bail. As a result, the official was very angry and slammed the door as he left.

Sun Meng’s defense lawyer [Tong Zongjin, 仝宗锦] pointed out that, with the aforementioned opinion, the defense lawyer was not trying to act like the second prosecutor, nor did he wish an innocent man to be charged with a crime; the defense lawyer was simply stating that “the case-handling agencies have not applied the law equally, fairly and justly.” As such, it is entirely possible that this important witness was given certain promises or instructions to make inconsistent statements in order to turn himself [or herself] from a suspect to the prosecutors’ witness. The prosecutors’ evidence presentation did not exclude such reasonable doubt of the defense lawyer.

Sentence:  Sun Meng (孙萌, Sun Dawu’s older son): 12 years fixed-term imprisonment, and a fine of 1.9 million yuan

Sun Dawu's second son, Sun Fushuo 孙福硕 , said: “I don’t know what forced confession made under duress means, but after I was arrested, they handcuffed me to the interrogation chair for more than 30 hours, until my legs were swollen. They all knew what they were doing. The police interrogators made it clear: Don’t think we can’t make you submit; we can place you under RSDL. I knew that RSDL was terrible, and I was scared. The subsequent interrogation transcripts were made under such duress.”

By book, Residential Surveillance in Designated Locations is a relatively minor form of criminal detention measure, but the experience of the defendants in the Dawu case made clear that under RSDL “death is better than life”. Given that these places are without humane living conditions, that female relatives are held as de facto “hostages”, and that investigators used threats and deception for their aims, RSDL has in fact become “illegal detention”. The defendants’ confessions obtained under such circumstances is of course illegal evidence and should be excluded in accordance with the law.

Liu Ping  (刘平) was General Manager of Dawu Group.  She was arrested on her visit to  Hainan Island where Dawu Group has a subsidiary.  She has been with the company for more than two decades.  She is one of the seven detained under terror and torture in RSDP.

So far, of the 28 detained, it’s said that three have since been released and seven have been placed under “residential surveillance at a designated place.” They are: Sun Dawu (the Director of the Supervisory Board), Sun Meng (孙萌, Chairman of the Board of Directors), Sun Erwu (孙二午) and Sun Zhihua (孙志华), Liu Ping, Jin Fengyu (靳凤羽, deputy General Manager of the Group), and Ji Weilian (纪玮莲, secretary of the Group’s general office). Sun Erwu (孙二午, or 孙德华  Sun Dehua) also expressed disbelief at the charge: “So we were spending money to buy a crime! We bought a crime with 400,000 yuan! I just want to ask: isn’t it true that we gave the restaurant owner a street-front location? If Dawu were to eliminate competition, why would we help relocate the restaurant to a street-front location?”

Sun Erwu believed that all the witness testimonies of the incident were false. The village Party Secretary Yang Xueming was in charge of this matter. Only after he viewed the live video of the scene, said Sun Erwu, did he realize the seriousness of the incident. He did not arrange for anyone to block the warehouse, and no one had informed him about it afterwards. He should not be held responsible.

Sun Dawu was considering whether he should cooperate with the construction of the expressway passing by the Dawu Group.

"Freak" State Farm

"The leader of the farm is the one with the most power. Now the farm has 7,000 mu of land, and the farm manager can issue a contract to anyone. All the profits are determined by the farm leader. As long as the farm employees don’t make trouble, everything will be fine. Regarding the management of the farm. There is no need to ask for instructions and no discussion. There is also a democratically elected village committee in the countryside. When something happens, the village committee will discuss it. It is hard to understand who the "owner" of the local state-owned farm is. Strange phenomenon." Sun Dawu said.

In fact, in my country, in addition to Xinjiang, Heilongjiang, and Hainan, which have vast farms built by the country after the founding of the country, state farms such as the local state farm in Baoding are very scattered in traditional agricultural areas.

The formation of Baoding local state farm also has a very complicated historical background. The reporter learned that Baoding Xushui County was the birthplace of the People’s Commune, and the local state-owned farm in Baoding was also established in the tide of the “communist wind” that year. According to Zhang Hongsheng, head of the farm, the farm was established in 1958 during the Great Leap Forward. "It was mainly formed by using unplanted land and wasteland in the surrounding villages."

However, the farm also requisitioned large amounts of land from surrounding villages such as Dingzhuang Village, Langwuzhuang Village, Mazhuang Village, and Zhaizhuang Village. It is understood that the state-owned farm has more than 5,600 mu of arable land, of which more than 2,400 mu is rented out. A complaint from the surrounding village committees obtained by the reporter shows that the farm occupies a total of 5085 mu of collective land in the four villages of Langwuzhuang, Mazhuang, Zhaizhuang, and Dingzhuang, which shows that it occupies most of the existing land area of the farm. . However, Zhang Hongsheng's statement is "not so much."

Now the country’s subsidy policy for agriculture is becoming more and more generous, making the difference between farm workers and surrounding villagers more prominent. Locals told reporters that the per capita arable land of surrounding villagers is less than 2 mu, while farm workers only have more than 100 people. The per capita arable land has reached fifty or sixty acres, which is very rich. This naturally makes the villagers psychologically imbalanced, so they hope to get back the land that has been freely occupied by the farm for decades. After all, they did not respond to their petitions over the years.

"Where is the root of this problem? The "Property Law" has left blanks," said Bao Yujun. "The Property Law has left a lot of blanks when it comes to the rights of the state, collectives, and individuals. Among them are the contractors of state-owned farms. If there is no usufructuary right, it is a question of whether it is the owner of the right of use. When explaining, use the collective explanation to deal with you. In fact, it is whether the private enterprise’s contracted lease use right has been denied, so you are in a very dangerous situation, when? If you have to accept it, you can accept it. Contracting and leasing cannot be protected by law. This is a critical issue."

Therefore, Bao Yujun suggested that the owner of the state-owned farm must be found. This is the root cause. “In fact, not only state-owned farms, but state-owned forest farms, fisheries, and salt farms all have similar owner problems to be solved.” Sun Dawu’s plan is to restructure Baoding local state-owned farms, “it is possible to reserve a considerable amount of land to the original workers of the farm. As a resettlement for them, to ensure their livelihood, other land should be returned to the surrounding villagers. Otherwise, these problems will erupt sooner or later.

A basic tenet of law is that a defendant has the right to meet his accuser. At trial, Sun Dawu has the right to meet the owner of the state-owned farm. If the owner cannot be identified then charges should be dismissed.

Sun Dawu: Talk about the protection of legal persons’ property rights

2016-11-17 18:19 Reading (633)

I believe that the property rights of legal persons are a kind of public power, while the general meeting of shareholders is a kind of private power. Property cannot be named public, and public power cannot be named private. Property can be inherited, but the position of the manager cannot be inherited. The position of the chairman is a public power, because the chairman is not the power of the general meeting of shareholders, but the power of the legal person's property rights.

I have tried to communicate with Dawu Group without success.  Letters to Langwuzhuang and even Baoding are being returned.  Therefore, I will write openly.  Miss Ji Weilian (纪玮莲) is pictured on the left. She is Sun Dawu's personal secretary. Both she and Sun Dawu among others have been arrested. With respect to Sun Dawu it should be noted that his entire family has been arrested. Both Ji and Sun are my personal friends.

I was rather shocked to read comments made by both at the pre-trial hearing as well as other family members. There is a horror and terror experienced by them.  Sun is being fed pickled vegetables even though he is the Chairman of one of the largest agricultural enterprises in Hebei Province. Miss Ji cannot keep food down.  Sun's grandchildren are left at home without proper supervision. To understand this matter you have to know that Sun, his wife (Liu), his two sons, his brothers and sister-in-laws have also been arrested. I have known them all since 2002. They are decent people.

一句“我无罪,但是我伏法”代表着他的悲与愤,9年后,这种悲与愤远未消逝。

The phrase "I am not guilty,  but I am not guilty" represents his grief and anger.

Nine years later, this grief and anger are far from gone.
